My husband was denied a tourist visa to come visit me (we weren't married at the time) in 2009 because he didn't bring sufficient papers to the interview. We put that on his DS-260, but I'm wondering if anyone thinks it will have an effect on getting the CR-1 visa. We got married in March 2011 and have done everything correctly so far in the visa process. Our interview is coming up soon and I'm just getting nervous about all the details.

If anyone has any idea if this could effect the approval of our visa or has any advice that would be great.

My hubby was denied a work visa in 2009, and he acknowledged it on the forms and in the interview. He was put into AP, and the lawyer with whom we consult speculated it was because they wanted to investigate any wrongdoing surrounding that visa application (or if he traveled anyway, overstayed, etc). Of course, with AP, all you can do is speculate, so we don't know if it's that visa denial or not.

I don't think it will have any bearing on your husband's current visa, and it is better to acknowledge it than to not.

I've heard plenty of people talk about past issues with crossings, denials, and such, and they still get approved even without AP. Take any anecdotal evidence with a grain of salt, anyway, including mine.

Oct 6, 2011: NVC process completed
Nov 4, 2011: Interview date assigned
Dec 2, 2011: Interview at Consulate (Result: AP - No reason given on 221g)
Feb 7, 2012: Passport requested by Consulate
(...Husband needed passport for personal reasons during this time...)
Apr 9, 2012: Passport mailed to Consulate
Apr 25, 2012: Visa issued
May 1, 2012: Visa in hand
May 31, 2012: POE at Montreal's Trudeau Airport
Early July: Physical Green Card received in mail. Yes, it's green!

March 13, 2014: ROC filed (went to VSC)

March 17, 2014: NOA

April 22, 2014: Biometrics appointment

December 9, 2014: Case inquiry initiated

December 11, 2014: Response: "The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required security checks remain pending."

March 14, 2014: Received NOA that approval had been given on March 10; expect new GC within 60 days.

Tourist visa can be denied for many reasons. It doesnt make any trouble if he didnt make any false comment that could mark a red flag on his file.

My husband was denied a tourist visa to come visit me (we weren't married at the time) in 2009 because he didn't bring sufficient papers to the interview.

We are in a similar situation. Wife was denied a F-1 study permit in 2009 and her then-active tourist visa and a prior & unused F-1 study permit was cancelled. She subsequently applied for a tourist visa and was further denied. Both cases issued 214b letters. We specified this on our DS260 application but we do not believe this will adversely effect the application as (1) she did not enter or remain in the US improperly at any point in the past and (2) The CR-1 is an entirely different visa category.

Our interview in Montreal is expected next month and if there are any problems, I'll be sure and return here and report.
