I don't understand why it takes so long for VSC to approve petitions after an RFE. I have been looking at some different people's timelines and it seems that almost every person with an rfe for a K1 has had to wait close to 60 days for an approval. That is ridiculuous! I know they get a lot of petitions, but if you have already had to wait 4 months to get a response like I did, and then get an RFE. I returned the requested information to them within 10 days. I would have had it to them sooner but they sent the original RFE to my lawyer, so I had to wait for him to send it to me. I only hired him for the petition. I plan to do the rest of the immigration process myself, thanks to VJ!

06/10/2015-Went to info pass appt. Hubby got a 1yr. Extension stamp in his passport and biometrics done

08/12/2015-ROC Approved. Got letter in the mail.

08/29/2015-received new card in the mail.

It's true for most of the latest RFE's and the 60 day wait. We received our RFE 5 months into the waiting. The document requested took 3 weeks to obtain. USCIS received it October 18. We know what the RFE says...

We will notify you by mail when we make a decision or if we need something from you. You should expect to receive a written decision or written update within 60 days of the date we received your response

Wait, wait, and more freakin' waiting.

This is often heard from by people that hire lawyers.

It is also why I say to make SURE you have everything right, it is better to wait a few days to send it and check it again. Sometimes putting it aside and then checking again in 2-3 days os a good idea. We have countless threads here of people who send the petition and 3 days later look at their COPY and say "OH NO!" Do that BEFORE you send it.

The reason it takes so long?

Simple.

RFEs have no priority. The Service Centers have an obligation to attempt to meet their goals, I know that sounds like a "definite maybe" but that is a fact.

YOUR petition has been adjudicated and they have met their obligation to you by law. You did not submit a complete petition, that is your fault, not theirs. They need to get on to others. If that sounds harsh, it is not, it is the facts.

RFEs slow down the system for everyone. It requires that your petition be adjudicated twice. You are causing a person that could be doing someone else's petition to look at yours again. Not picking on YOU per se, but just as an example. So there is a long line at the post office and someone ahead of you gets to the counter and does not have their forms filled out right. The clerk tells them to go to the table and fill out the forms and come back. The person does that. Do they now get to jump ahead of you again in the line? How would you feel about that?

Petitions are adjudicated in about 20 minutes and get approved or an RFE. If a person is spending a day reviewing RFE responses that is 20-24 other people that do not get an approval that day.

I assure you there are people in USCIS that would love to respond to the demands for faster service by simply eliminating RFEs and denying petitions that do not meet the requirements. They do it for other petitions all the time and embassies do it for any other type of visa. "You did not fill it out right...denied. Try again."

We have here at this site people who complain about waiting for their adjudication and then complain more when they have been adjudicated and received an RFE. How soon will I be approved after an RFE? Means "How many people will they bump in line to get to me again because I messed up my chance the first time but I am still more important than anyone else because I am in love!"

I suggest everyone read the instructions, check and double check your package, ask questions, err on the side of caution and THEN send your petition.

You are waiting longer because you made a mistake. You would have had an approval by now. The RE would have been an approval if your petition had been complete. You are waiting even longer because other people made mistakes and instead of denying incomplete petitions they spend time to review them AGAIN.

You are waiting even longer because other people made mistakes and instead of denying incomplete petitions they spend time to review them AGAIN.

Just for the record. We purchased a guide and followed it verbatim on what was required. Including the divorce had to state when the divorce was final and when I was free to marry. The document CLEARLY stated those issues. So you don't know everything about everything. Must be nice to live in your perfect black and white world.

Also, on the RRE, it states just before the bit about the 60 days: "From the date this office receives your submission, it will take a MINIMUM of 14 days to process your form."

so,.. it CAN BE much quicker. Which is what I'M EXPECTING! :D

My RFE was for an old domestic charge that was supposedly destroyed. So I wrote an attachment telling what happened and when. It wasn't that I made a mistake. I have talked to people with worse charges than this and all they did was write a letter and it was accepted. The charge was from 1999. My lawyer was even surprised that they got me for that. I was lucky that I knew someone at the courthouse because the file is marked destroyed and I wasn't supposed to be able to get access to it. This is the govt! They have the ability to look these things up a lot easier than we do.
