Hello everyone,

My husband and I filed his ROC in May of this year and we are still waiting. He was planning to go back to Uganda in January to finish up some family business, however, we are afraid he won't be let back into the US without his updated visa in hand. We have an extension letter, and I have read here that it shouldn't be a problem, but I don't trust it. We thought we would have his renewed visa by now, but looks like the VSC is extra SLOW. Has anyone had problems coming back to the US with an expired visa and extension letter? Should I be worried, or should we go ahead and buy the ticket?

Thanks so much for any advice/feedback! :)

Why is he getting a visa if he applied for removal of conditions to get a 10yr green card?

I understand that you didn't trust Idi Amin, but you can trust the U.S. government that when they extend his Green Card for another year and give it to him in writing, like they do it to a few hundred thousand people ever year, that this is not a hoax.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

As long as he has his valid passport, a GC that expired less than one year earlier, and the original of the extension letter, he'll be able to reenter the US with no problems.

I wouldn't try it if his return date is more than 1 year after the GC expiry date, but as long as he's reentering within the one year window defined by the extension letter, he should be fine. I heard of someone here recently who ran into a CBP officer who thought the letter only extended his PR status to one year after the letter's issue date, not one year after the GC's expiry date, but that just seems like a simple misreading of the letter that would be quickly cleared up by a supervisor or two.

Haha! Ok, point taken. I suppose I had doubts, because we have gotten some trouble from immigration officers who don't seem to know what they are doing. But I guess you can always ask to speak to a supervisor. Thanks everyone for your reassurance :)

Who mentioned any trust issues with Idi Amin? I suppose this was simultaneously your attempt at humor (seeing that the OP displays a Uganda flag), and your wish to display an elementary familiarity with dictatorships in Africa? Nice try.

It's a little irritating that you run across the various threads with responses marred by sarcasm of a racist, nationalist, and homophobic (or at least mocking of homosexuals), tone of condescension. It's all the more a pity since the vast majority of your responses are concise and insightful.

Can I ask that you restrict your gay jokes, hispanic jabs, and covert disdain for certain nationalities to the privacy of your home/local bar/local salon/wherever? In a heterogeneous group such as this is bound to be by definition, your snideness runs the risk of falling flat; a risk you are not likely to face when entertaining like-minded family and friends with your bigotry.

I am also waiting for ROC and I have extension letter and even a stamp i551 in my passport that says its valid for 6 months( I just got it 2 weeks ago). I am going out of country, home, for holidays with my husband American citizen, but I need to catch connecting flight in Zurich. My only concern is that my friend told, her friend had same extension letter, old gc, stamp and they (Germany) didn't let her come back to the USA! She needed to with for a few months back home until her husband was able to bring her a new gc, which was appearantlly approved while she was out of USA. After that story, I am really scared. We are leaving in 3 days and I cannot think about anything else, because I need to come back, my job, my school, my life is here, and now I am afraid they won't let me come back... Anyone knows somebody that was not allowed to come back to the USA, while his case was pending?

Thanks for any feedback

you should not have a problem. you have valid LPR status in the us and 2 documents to prove it. lots of people travel with the extension letter or the i-155 with no problem. yes, you may spend a little extra time at CBP, but you'll be fine.

there was a recent post about a member's experiences with travel abroad with a pending ROC. ill see if I can find it.

Thank you very much, I appreciate your help!

This post help me calm my nerves just a little :)

The other thing, the officer at uscis, who issues me a i551 stamp cut one corner of my green card, but I guess he knew what he was doing, and he told me to use my old gc just as an indetification! I am just scared of people who work on custom but do not know who this thing work. So I hope I will spend even an hour on border, but I will be able to come back to USA! I ll keep you guys posted... Happy holidays!
