Hello,

This part of the process is very confusing and I thank everyone for the help so far. Just to make sure I am doing this correct I'll ask to make sure. For me I fill the form I-864 and state I am not required to file Federal tax returns. My parents file joint Federal tax returns but we only need to use my father as a joint sponsor. So, my father will also fill out a I-864 form and include the copy of Federal tax returns for the last three years. Thank you for any help.

You need to give a reason for not being required to file a tax return, not just simply state that you are not required to file.

The joint sponsor will submit proof of income claimed. If a wage/salary earner they would submit recent paystubs and an employer letter to support the income claim. If self-employed, the income used is from line 22 of the sponsor's most recent federal tax return.

hello,

My dad has copies of the Federal tax returns and copies of his w2's for the last three years. I, however, have not worked since November/December 2003. I worked at Target for their seasonal work and that's all the work I have done in my life. When I worked at Target I didn't make enough to file taxes. I have been a college student since the day I left high school. So how would I state to them I have never really worked? Thank you for the help.

Read the form instructions (specifically page 8) to learn how you need to respond regarding not filing a tax return. From what you are stating you will explain that you have been a full time student and did not earn any income for the years (20XX - 20XX).

Have you father read the instructions as well to make sure that he supplies the needed information about his current income. Past years' tax information is not enough if a person is a wage/salary earner.

Hello,

I read page # 8 and it says I just need a written explanation stating I have never earned an income high enough to file Federal taxes. I'll state I have been a student since I finished high school, though not a full time student all the time, and I am near finishing my 4 year degree. I'll add a letter from the school stating I am a currently enrolled student. If there is anything else I am over looking please tell me. Thank you for the help.
