Submitting only the latest Income Tax Return for interview at USEM

Hello guys, I have a question, Is it Ok if we will only present/show to the CO the latest income tax return of my fiance during the K1 interview at USEM instead of showing the last 3 years income tax return? We are worried if we're going to show the last 3 years as his income was low the past years. By the way, his income right now is more than enough to support me. Please help us everyone. :crying:

Help me here with your question Love. Are you saying 2010 Income Tax Returns are above the Requirements. Thats good.

Currant Income with pay-stubs, letter of Employment show ALL GOOD.

Then NO. You do need 3 years Tax Returns.

By the time of your Interview looking at your timeline a 2011 Tax Return could be used alone. I think your LOOKING GOOD!

01/31/15..... I got my SSN from the mail

04/20/15......AOS Interview - Approved :star:

4/24/15 .......Got the Driving Permit Card

4/30/15 .......Green Card Received :) (Exp.4/20/17)

when I had my interview last March, I had the 3 years income tax of my hubby but the pre-screener only took the latest year (2010) and give me back the 2008 and 2009 return. He also took the letter of employment and gave me back the 4 latest paystub.

Based on that, its okay.

it's true they use the current years income to base the decision on, the only time they would look at the earlier years is to see the stability of your income over a period of time.

So if you just started a new job, this year, they may want more info then someone that was in a job for 10 years.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Hi Tim/Mav, Actually we are planning to have my interview by February after my fiance filed his taxes. The last 3 years (2008),(2009,(2010) of my fiance's employment, he did not meet the required income. But just this year he got a good paying job and more than enough to support me. So hopefully we can use a 2011 Tax Return alone. He do have pay stubs and will get an employment letter from his company. Wow, what a relief! :) Thank you so much for the quick reply. :) :)

Thank you Bobby+Umit, I wonder if we can still present the last 3 years even though it was low and will just make a statement/explaination.

Yes, the current income tax return is fine. :thumbs:

Also submit current paycheck stubs, W-2's, 1099's, and employer letter.

the i-134 only requires 1 years taxes, and that's what we used with no problems. the i-864 is for aos, and that one requires 3 years taxes.

Do not go by the I-134 instructions. Embassies can have different requirements. Go by the requirements of the Embassy where you will be interviewing.
