Well, I just received an email from USCIS, stating the following:

I guess that means they still want me to give them the arrest records while, in fact, I am not able to produce that document... in other words: I'm screwed for something that I didn't even know at the time that I was doing.... sigh :(

indeed, Official police records are not released to the public n the Netherlands. In fact people who have never been arrested don't even have one over there. Maybe you should obtain a testimony of moral character i.o.w. verklaring omtrent het gedrag'. I'm nit sure if that covers USCIS desire. otherwise contact foreign affairs to ask them if they can help.

Hold in there, it may have nothing to do with the arrest. At least it looks like the information is on the way to you so you should know soon. Please keep us informed and I hope everything works out okay for you.

You're right, it doesn't have to mean it's actually about the arrest record, but seeing how my day went, it is possible they do want it after all. I guess I'll know in a couple of days when the RFE comes in. I'll post what it is once I know :)

I'm unsure if I can get the VOG, thing is that I believe you have to be registered with the 'burgerlijke stand' in the Netherlands in order to get this (this is out of the top of my head, I could be wrong about it though) and that the 'burgerlijke stand' also has to give it to you. I will wait until I know what the USCIS wants from the RFE but if it turns out they indeed want the arrest record, I will first call the justice department, the Dutch consulate and maybe the US consulate in Amsterdam, perhaps that they can give me a letter or something in which they state that I cannot get that information. I have no idea what else I could do.

I just checked online and according to justid.nl (a Dutch government site) it is possible to look at the documents in person at the district court of the city in the Netherlands that one lives in... obviously I do not live in the Netherlands so even if I wanted to see the papers in person (and, to be honest, I don't feel like that at all as it will cost me at least 1500 USD in travel costs alone), where would I look at them? They will never send this out, it can only be looked at in person...

And actually, the whole situation might become even more weird... I read they either keep data for 5, 10 or 30 years depending on the weight of the crime and outcome of the court ruling (and then depending on the weight of the crime, they might add 10 years again). In my case, I transported stolen goods but never knew they were stolen when I did, I only found out after I got arrested. The court ruling was a suspended fine of 500 guilders (about 280 USD at the time). Suspended meaning: if I would do anything within 2 years, I would have to pay a fine of about 280 USD. I never had to pay anything as it was my only mishap.... so, really, if you think about it, even if I am able to look at the records, it might be very well have been erased as it happened 14 years ago and I doubt my "crime" was heavy enough for them to keep it 30 years...

But, like said by Darren and Crissy, maybe it is something else that they want.. I hope it is something simple and not about the arrest/police records because I have no idea how that will end if they need that :/

Hi Jeroen, I found this on the VOG. It looks like you can still order a VGO in the last county you registered with assuming you left NL after 1994. They also give you the option of having someone else getting it for you on your behalf. It looks like you were a first and last time offender so I don't see any reason for them to refuse you the VOG. This is probably the route you want to go in case USCIS comes back to you on this issue.

Hi Jeroen, I found this on the VOG. It looks like you can still order a VGO in the last county you registered with assuming you left NL after 1994. They also give you the option of having someone else getting it for you on your behalf. It looks like you were a first and last time offender so I don't see any reason for them to refuse you the VOG. This is probably the route you want to go in case USCIS comes back to you on this issue.

Thank you for looking this up. Hopefully I don't need it but it might be better than nothing at all if it turns out they still need something. Kind of hope they will accept this in that case, because I know the US consulate wouldn't accept the VOG.

Edit: it makes sense they don't always accept it as it doesn't say anything really about someone's behavior. The government could feel someone is ok to receive a VOG but still might have done something in the past. I'm pretty confident that USCIS will accept this. They want to make sure you have nothing else on your plate in the Netherlands. This document would show you're in good standing with the Dutch government. It concerns a nationwide investigation by the Dutch Justice department so what else can they rely on. I think this would pretty much satisfy their needs.

Sorry to hear this turned out to be an issue for you at the interview. Let's hope the RFE isn't for the court record. If it is, then there are a lot of people on here who will be putting their heads together to help you figure it out. You will become a citizen!

I'm pretty confident that USCIS will accept this. They want to make sure you have nothing else on your plate in the Netherlands. The problem is that they don't want to see if I have anything else on my plate, what they want me to show them is how the case was handled by the police, the exact story behind it and all, this is why they want the arrest records. This is why I highly doubt the VOG will be any good because it doesn't show anything really in that regard.

However, maybe it doesn't matter anymore as I received an email from USCIS yesterday afternoon stating the following

Your Case Status: Request for Evidence Response Review

On April 19, 2012, we received your response toour request for evidence.

Seeing how I never submitted any evidence yet (since I never received the RFE in the mail yet), I'm starting to believe it may have been for the biometrics. Perhaps they received the bio results and now have what they need. I just hope that the rest of my case review will be ok as well :)

Sorry to hear this turned out to be an issue for you at the interview. Let's hope the RFE isn't for the court record. If it is, then there are a lot of people on here who will be putting their heads together to help you figure it out. You will become a citizen!

Thanks. As you can see in my quote a little bit above, it might not have been for the court session but probably was for the biometrics. I surely hope it was only this and that my case will move forward now :)

O.K. People

My interview was on Wednesday the 18th.

My appointment was scheduled for 1.15pm in Los Angeles. I left home at 11.30am just in case traffic was bad on the 405 freeway.

Normal time to get to L.A. without too much traffic is about 40mins.

Traffic was heavy and i got to L.A. at about 12.20am. I am not to familiar with down town L.A. so i was relying on my iphone's GPS to show me the way.

I got to los Angeles street, but could not find the building or could'nt see the number of the building. After a couple of circles going around the building i finally asked a security guard and he kindly told me that the build was the right one , but there was no parking. Public parking was three blocks down the street.

After parking, paying $5.00 and walking all the way back in high heels, got to the door at 12.57pm. It took another 20mins to go through security.

Went to the interview room and was told to take my letter to window #1 and take a seat. All of a sudden durning my wait, i started getting very nervous. I was called by a nice gentleman who very impressively pronounced my full name, which is 4 names long.

He pronounced my name correctly,and i told he so.I was asked for my Driver's licence, greencard and passport.

I was then sworn in and we did the civics test, after the 1st 6 questions he stopped, then he asked me to write " California has a lot of people"

and he asked me to read three easy sentences.

We then went through my application, and all the questions, even my traffic tickets, i had listed 7 tickets, speeding, running red lights,suspended car registration etc. At the end of the interview, the computer could'nt close my interview out and so i could not get the congrats. letter. So they will send it in the mail.

But besides that, the interview went well and my officer was very nice.

SORRY i was nervous so i dont remember the rest.

SO my worry is why did the computer refuse to close my interview- Traffic tickets?

The problem is that they don't want to see if I have anything else on my plate, what they want me to show them is how the case was handled by the police, the exact story behind it and all, this is why they want the arrest records. This is why I highly doubt the VOG will be any good because it doesn't show anything really in that regard.

However, maybe it doesn't matter anymore as I received an email from USCIS yesterday afternoon stating the following

Seeing how I never submitted any evidence yet (since I never received the RFE in the mail yet), I'm starting to believe it may have been for the biometrics. Perhaps they received the bio results and now have what they need. I just hope that the rest of my case review will be ok as well :)

Just got back from my interview, and unfortunately it didn't go so well in my case either...

I don't want to make a too big review as I am about to go out again (got family visiting me from Europe and want to do some stuff still with them) but I do want to give an idea what went wrong. My IO was nice in the beginning, joking and such.. however, the closer we got to the interview room, the more serious she became. Not that it was unpleasant, I just had a hard time dealing with such a fast switch between small talk and serious talk.

Anyways, I aced my tests, actually had to laugh at the first question as that it was exactly the one and only question I often made a mistake with when rehearsing with my wife lol. Anyways, I did remember that question and all was well.

Then several questions were asked, basically all the questions we had to fill in on the N-400 form. Several questions were asked more than once for which I don't know what the purpose was, like my daughter's age who lives in the Netherlands.. I am not responsible for her in any way and have no say in anything regarding her nor will she ever live with me and I hardly have any contact with her (she doesn't want to speak to my side of the family anymore) but oh well.

And then the question came about my arrest thing from 1998 came up.. Many questions were asked about this which was ok, but then she told me she wanted the arrest record. And, like I said before in this thread, that is one thing my country does not allow it's citizens to get. When you file for the K1, for example, the consulate itself will get that information from the government but we do not have to provide the US consulate with those documents as my country simply does not give it out. I can look at that kind of documentation but I cannot make copies or even touch that documentation so to say. And when I explained that, she told me she really needed it and couldn't make a decision without it.

How am I able to give something to her that the Dutch government doesn't allow me to have? It is like entering Area 51 without any clearance, it is simply not possible to do.

Anyways, she asked me a couple of times for it, and I kept saying it is impossible to give it to her. Then she told me, well, congratulations, you did pass all the tests but I cannot make a decision at this point because I need that document. So I said to her that it then didn't matter whether or not if I passed the tests because I am unable to produce said document. I was seriously disappointed and showed my disappointment as well. Before she even said so, I was already grabbing all my belongings together so I could leave because it felt as if things were over for me. Then she told me to wait outside with my wife for a bit so she could go to her supervisor as she needed an autograph for something.

When she called me back, she never asked for the arrest record anymore, but did asked for the original verbal court order that I brought with me (which I went through a lot of trouble for to get, and which is the ONLY document I am able to get in regards to that case). She then said I still needed to do my biometrics and gave me a document to get that done (she mentioned it before during the first part of the interview that she needed me to do this as it was not done during this N-400 application. She said that it is not correct that there is a 15 months validation on the biometrics but that it had to be done with every application you file, with the I751, the N400 and so on, regardless of how long ago it was... when I told her about the 15 months and such she said this was false information (funny enough, there was an immigration lawyer in the waiting room who overheard me complain to my wife about the process and, besides giving me some pointers in case I don't get approved, he also said that one IO says the 15 months are ok and the next is not ok with it.. according to him it varies greatly). She also said that if I never had the bio appointment letter, I should've come down to the office and tell them this and get a letter from them myself).

This was pretty much the end of the interview, it took about 1.5 hours and in the end she said that even if everything else was ok, she couldn't approve me anyhow since the biometrics was not done yet and this would take at least 5 days to process. Then I was told I would receive a letter in the mail about their final decision, when asked how long this could take, weeks or months, she laughed and said she didn't know, it could take weeks, or months...

So yeah, I really have no idea what will happen next. She said she would do some checks and review my application and such. I'm guessing she will contact the US consulate in Amsterdam, or the Dept. of State or something, to see if my story checks out. She asked me many times if it was addressed before, and it was addressed during the K1 interview and the AOS interview. I really have no doubt that my story will check out, question is only what she will do with it in the end.

It really pains me that this, something that happened 14 years ago, the only black page in my history, something that was done when I was young and stupid, and even worse: something I never knew at the time that was illegal (because really, I didn't even know that I was transporting stolen goods), is haunting me down so badly, time after time after time :(

Time will tell what will happen.

Nice. I hope you did catch a break and it was for the biometrics. Now you can move up to the next level of waiting.

On a side note it just seems that RFEs are rarely what you think they are going to be for.
