hi all

i am adam

egyptian man abt 40 years old of age

was married to an egyptian woman in 2003 and has two kids a girl and a boy god bless them and all ur kids

gods will that this marriage was a failure and i devorced her in 2007

the devorce was islamically ( just by words ) and not officialy no papers

since 2007 we were in courts ( documented)

my sister is an american due to her marriage with american egyptian guy and she gave the american nationality to my mum and dad who had the passports abt 4 years ago

i used to go to america plenty of time by tourist visa

i still have a valid visa tourists till 2014

in 2010 i knew sara

american in illinois she was working in the same place with my sister

who introduced her to me

we started chatting and sms

after abt 6 mnths she came to visit me in egypt for 5 days

and back to usa

we kept our relation for abt 8 months through net and sms

then i went to illinois

we got married in america illinois in cane county court and in islamic centre in march 2010

i told the clerk in the court that i devorced my egyptian wife by words islamic way but i have no papers

he said ok just give me your passport

so we got married in america i have a marriage certificate

we came back to egypt after a week of our marriage in america

since then we never left egypt

my wife is living with me in egypt for about 20 months

after my wife spent 6 month in egypt we filled for i 130 petition in american embassy in cairo in november 2010

in the form of i 130

i made a mistake

i thought that in the form they ask me about previous marriages from americans not egyptians

so i wrote none

big mistake

so during the interview

the lady asked for some fotos of our wedding and asked us how did we meet etc

all was good till she checked my name and found that i am married from egyptian woman

i told her yes

and i know that all my data about my egyptian marriage is in the data base of the usa embassy

cause i added it my self when i was getting a visa to my egyptian wife and kids before

so

no way i am hiding this

cause i know that the embassy knows

and i told the lady in cairo embassy that my american wife knowes every thing about that and about my kids and all

and i told her that i ddnt devorce my egyptiam wife on papers till now

so

she said i need to ask my manager

my wife told her that we are already married and this is a fact

the lady came back to us smiling and saying

you are right

your marriage is a fact now

but you need to give me the egyptian devorce document

and translate it to arabic

and send it by dhl and i will write a note on your file that when this devorce doc arrive the guy who will open your file again will add it and will correct he form that the benifetioner ( me ) was married before to egyptian woman and has two kids)

she said that she will not consider this a lie

but will consider it a missing document that need to be sent and gave us a paper that our file miss a devorce document

so

i finalised my devorce and got my devorce certificate and translated it to english and sent it back to cairo embassy via dhl

the devorce document arrived to cairo embassy in may 11 2011

for about seven month our case was held for mandatory administrative processing MAP

only in october 2011 we received a letter via dhl telling us that our petition was forwarded to uscis office in athens greece for jurisdification cause the embassy in cairo is not convinced that our relationship is true or valid

and that they cant do anything till the answer returns from athens uscis

and if we want to ask about our case we should conntact them in greece

we sent e mails to greece uscis

they said it arrived our case

and normally these cases take them abt 180 days to decide

and they asked us

to refrain from cntacting them to help them finish our case in the said period of time

we dont know what to do

we are real

married

and my wife is living with me in my country egypt about 2 years now

she never left to america or to any other country

we are sure they never investigated about us in the 7 month they left us in map

cause we live in the same house as a wifw and husband

and we were ready for them to ask or to come to us

or ask neighbours

etc

what we do now?

what is happening?

pls we need all your help

I will say right up front I know nothing about Islamic divorces, but if you were not LEGALLY divorced when you married your wife in the US, you are NOT MARRIED since you were able to be married since you weren't divorced, and if that is true, then you are in hot water way beyond not understanding the question on the I-130. You need legal advice right away to determine if your current marriage is even legal. Don't just take the advice of friends, the consulate, or anyone here--this could be very messy--I hope not, but it could be.

I agree with magical. This is complicated. I had to navigate through your story several times to understand this. Not only the legal situation is tricky, the fact that you didn't understand the form is also a red flag. Get a lawyer and good luck.

Don't ever do anything you're not willing to explain the paramedics.

If your Islamic divorce was considered valid in Egypt, then I believe USCIS officials would understand that this is a valid means of divorce. They have asked you to provide them with the documentation to verify your divorce and you have done that. They have said that they doubt the validity of this current marriage. I believe this is what you will need to address. You should try and gather together all of the documents that you can find - copies of your travels to the visit Sara, copies of Sara's travel to Egypt; your marriage documents, any evidence of your life together in Egypt - signed affidavits from friends and family members in both the US and in Egypt; write out a timeline of your relationship, from when you first met Sara and document each stage. Living together in Egypt for 2 years seems to me like a pretty strong indication of good evidence. If you have any 'red flag' reasons why your relationship might not be considered valid - different religions, big age differences, is Sara a relative of your sister's in-laws in America, things like this - be prepared to address them. You may wish to consult with a lawyer as suggested above.

If the petition has been sent back to a USCIS office, they will look at all of the evidence about the relationship and decide if the evidence indicates a real relationship or a fraudulent relationship. Ideally, they will 'reaffirm' the petition - which means they believe it to be a real relationship - and send it back to the Consulate in Cairo. Cairo may then request more evidence from you or require another interview. Did your wife go with you to the first interview? If not, see if she can make this second interview.

If USCIS agrees with the Consulate and cancels the petition, then you should speak with a lawyer. You will need to refute/challenge the allegations that the relationship is fraudulent in order to qualify for a new petition. You don't want that finding to remain on your file. So, gather together the documentary evidence that proves your relationship now. You will need it either to present to the Consulate for the re-affirmed petition, or you will need it to work with a lawyer to challenge the finding of fraud.

Good luck to you. I hope it all works out in your favour. At least you know that the two of you are together and can have a good life together in Egypt if that is what ends up happening. Hopefully you will both be allowed to live the life you want together in the US.

your case sounds very complicated for many reasons. first of all in usa n everywhere else in the world besides middle east u are allowed one wife only as u know. so that means even though u divorced ur egyptian wife technically ur marriage in usa is not valid because u were still legally married to egyptian n here saying I divorce u 3 times to a woman means nothing. so I see why they immigration has an issue with ur case, you got a divorce but little too late...sorry to be harsh but its my opinion. also, ur new wife moved to egypt to live with u for two years? , she moved to a country where u are allowed to have 4 wives, meaning ur old one that u just recenlty divorced n u have children with, and now ur new one...come on r u , of course immigration will see this suspicious, I would...but again its only my opinion and I might be all wrong. my advise stay in egypt with ur wife/ies or get a really good lawyer that can give a resonable explaination and lots of proof that everything has been done in good faith n honesty.

my question to u is if u got married in usa why u didnt just stay here ? you could have filed the forms here and within 6 months it could have been approved n u could have gotten a green card. ur interview would have been here n you would need proof here of ur relationship with ur new wife. its done a lot faster when the person is already in the usa and those cases most of the time get approved without problems not like regular i130 that takes average 12, 18 months.
