i have a k2 minor child but still bothering me about getting a permission from his father bc first of all we're not married & he doesn't really give a FULL support. my parents & i we're the one who raced him up from the very start even financially. but the thing is, he signed to his birth certificate & i asked about it from one of the lawyers here that our law here is the mother is the one's authorized for his children, legitimate or illegitimate. but still skeptical bc i wanted to be sure about this bc i want my child to be with me ones we get approved. i dunno what would be the USEM would feel about that. PLS HELP :unsure: thank you

The mother always has sole custody. It won't be an issue. It's unfair in my opinion in cases where the father is involved in the child's life but that's the law in the Philippines.

I'd be real careful if I were you, and investigate all agles of this thoroughly and legally. It was some time ago but when i married my filipina ex-wife in the Philippines she had a 2 yr old son. He was listed on the marriage contract and I petitioned for him just as I did his mother. One difference from your case is that his father's name was not on his birth certificate. When asked (and she was asked at every turn about the child's father - they even asked me!) she told that the child was illigitimate and she didn't know where the father was. That did not stop them from questioning her about his father. Again, it was some 15 years ago, but I got the impression then that if the father was known then he may have been contacted and had some say about his son leaving the country on a VISA.

I don't know the law in the Philippine's about these kind of things, and maybe the mother always gets full custody there. But I wonder if that applies the child leaving the country permanently on a VISA, also.

I'm just saying that its worth deep investigation to find out what you need to do legally to be clear and not have anything jeopordizing your plans. Make sure.

My 2 kids were illigitimate. The father's name was on their birth certificate and my kids are even using the biological father's name until now.Never had a problem as long as u two were not married legally. U have the sole custody of y9ur child.

thanks to you. would the father sue me a child abduction? bc he still have communications with my son even if it's rarely. when did you had your interview? are you K1?

Did you resolve you issue with your child and the father? You have sole custody under Philippine law. This is the same situation I had to deal with my fiance and her two kids. The father has his name on youngest child birth certificate but not the older childs. It didn't prevent my fiance from be able to get the boys passports. They are cleared to travel with my fiance when she finally gets approved for her visa.
