Timeline

We got denied in Sept and still havent heard nething from USISC yet or NVC? so Do you think we should cancel it and just try to get married in morocco or just wait to see if we can get another interview date? I heard it takes about 6 months to get another interview date? Can i call to see if they will re-approve it or if they have reviewed our case? or do i have to wait for them to send a letter?

It is really long process to re-review the case if once it is denied. What was the reason for deny the visa? If it is something related to non-bonafide relationship, then you really have to make your stronger case. Getting Just married, and then apply 1-130, may put some risk, as it will keep in record about K1 was denied.

I would say wait a few months before jumping the gun. You need to know why they sent your case back first. Have you contacted your Congressman/Senator to do an inquiry?

01/2006 - Filed k1(1st time)

04/2006 - Interview (1st time) denied

Waited, waited...... no review

06/2009 - Filed k1 (2nd time)

09/2009 - NOA 2 approved

12/2009 - Interview (2nd time) APPROVED! VISA ISSUED

02/2010 - Arrived USA

04/2010 - Married

AOS Timeline

4/19/2010-Sent to Chicago Lockbox

4/26/2010-Received texts and emails 7th day

4/30/2010-Received NOA's(Hardcopies) 11th day

5/3/2010-Received ASC appointment notice(mailed 4/29/2010)14th day

5/7/2010-Walk-in Biometrics done(2 weeks earlier)18th day

5/13/2010-Case transferred to CSC

6/2/2010- Case received/resumed at CSC

6/18,6/22,6/23 AOS touches

6/28/2010- EAD production and touch on AP

6/29/2010-AOS APPROVED

7/2/2010- 2nd update on EAD production and touched on AP....

7/6/2010- Received "Welcome Letter" and AP document

7/12/2010-Received GREEN CARD and EAD

my fiance was interviewed the day before you.and he was given a white paper with only "your petition will be returned to Uscis" we thought he was denied, but to find out it was returned for further review.as i have done some inquiring i found out even it you refile, your out come will not change..and you just be waisting time and money till you find out the reason and fix the problem.some consulates do not send files back as they interview but waite till they have many and send all at one time.Ours have not reached Uscis eithor.i know this is hard as we are waiting to,but dont feel your alone..but i hope this helps.

Our K-1 was sent back for further review then closed because the dates expired. Congressman/senator were no help to us. We received a letter letting us know that our case had been closed due to the dates expiring and we could file again.

thanks u soo much for ur answers. so basically its gonna expire and we should just refile. Clearly that what they want to happen otherwise they would have sent it back by now and if Hadd4everlove's didnt go back yet and its about to be 3 months then its probably gonna expire. so I guess im getting married. Our reason for denial wasnt nething big like faud just returned for futher review.

Yep sounds like it will just expire...... So just start planning your next trip back and make sure you have all of your documents when you go :0) Good Luck :0)
