I do not quite fully understand how the process works with the issuance of the K2 visa, especially as it relates to our particular situation.

Ira does not want to pull her son out of school in the middle of the year, he is going to a school that specializes in mathematics and physics and this year many of his classes reach their culmination. So, the plan is to leave him in school until is final exams in the middle of June. That is first.

We are at the point where we are ready to schedule our interview. Ideally, we would like to schedule the interview for the week of November 21st as he has vacation and would not need to miss any school for the week they will need in Moscow for the medical exam and interview. Also ideally we would like his visa to be issued by February so that in the case of an emergency he could travel to the US while we are adjusting status here.

This is what I know:

He must be applied for on the I-129f,

He must get the medical exam,

He must attend the interview with his mother,

The K2 visa can be issued up to a year after the K1,

The K2 once issued is valid for 6 months,

Our intention at this point is to have him travel to the US immediately after his exams June 15th...

What I do not know is how exactly the K2 issuance in the case that he follows us works... any help and clarification would be gratly appreciated.

He is NOT required to attend the interview with momma... He attends the interview when he is ready to be issued a visa. His interview and visa issuance can occur up to 1 year after momma's visa was issued.

This is what I know:

He must be applied for on the I-129f, ALL her children should have been listed on the 129f, regardless of their immigration intent.

He must get the medical exam, Yes, prior to his interview, they are good for up to a year.

He must attend the interview with his mother, No, he'll have his own, when you schedule his when he's ready, but must be within one year of the issuance of mother's visa.

The K2 visa can be issued up to a year after the K1, Yes

The K2 once issued is valid for 6 months, Yes

Our intention at this point is to have him travel to the US immediately after his exams June 15th...

You just contact the Embassy, email works, and schedule his interview. Since you listed him on the DS-156 (or is that the DS-156K?), they will have that record of your and his intentions. Works very simple.

This is the verbage from the embassy website:

"All children (under 21 years old and unmarried) of an alien classified K1 should be listed on I-129F Petition for Alien Fiance(e). Children also must be present at the interview. The child of a K1 principal alien may acquire K2 status even after the principal alien has married American Citizen Petitioner and acquired lawful permanent resident status in U. S. A marriage certificate of the principal alien along with the rest of the required documentation must be provided for the child's visa interview in this case. The cut-off date for issuance of a K2 visa is 1 year from the date of the K1 visa issuance to the principal alien."

Now, he is 15. Right now he lives in Volgograd which is a little ways from Moscow. His grandmother will be staying with him while Ira is here...but it is a little problematic to have him (or expect her at 72 to take him to Moscow for an interview) to travel to Moscow for an interview. After talking with the people at USTRAVELDOCS is seems that the consulate can determine the dates that the visa is valid for...but this is a call on their part. It seems to me to be an easily granted request to ask that his visa be made valid for entry after January.

Any thoughts?

I went through this same problem. My then fiancee had her interview in March a few years back . She and her 16 year old daughter went to the interview together, and I was with them, but of course not inside the embassy. My fiancee and I were planning to travel back to the US together a week after the interview, and her daughter would stay and finish school and travel in June.

When they exited the embassy I could see there was a problem. My fiancee was approved for the visa, but they said that her daughter would have to return for a second interview closer to when she wanted to travel. We were stunned and just started walking to get something to eat. Surprisingly, after about 45 minutes my fiancee's phone rang and it was the embassy calling. I spoke with them and they wanted to clarify when the daughter was planning to travel as it had not been discussed during the interview. Since the daughter was going to travel just 3 months later they said they would approve the K-2 and send it along with her mothers K-1. (So glad I was in Moscow for the interview) If she would have been traveling 6 months or more later then she would need to return for a new interview.
