Tourist visa B2 some help

Hi everyone! and thanx in advance...

Well, this is the issue, my brother in law tried to cross the border from Mexico to the U.S. illegally like 4 or 5 years ago maybe 6 (for sure I know is more than 4 years) he was only like 16 or 17 years old, but he was caught by immigration officers (border patrol) and they took his fingerprints and a photo of his face, then he was sent back to Mexico and he never tried to cross again. Now he wants to get a tourist visa(B1/B2) to visit us because our son is due on January 2012, he is 22 now and he owns his own mechanic shop, and he is register with Hacienda(he pay taxes for his shop) I am familiar with the process and paperwork needed for the visa, because I helped my parents in law two years ago to get theirs, which they got, now I know his case if more difficult to do, and I just want some guidance with the process.

I also want to know how long immigration will keep his fingerprints on their database.

I also know if I am not wrong, that the law is a little different when you still not an adult and got deported from the U.S. (why I’m trying to say that is not that hard to get the visa because he was still considered a child)

I also heard something about that he needs to ask for a forgiveness or pardon, whatever the word is called, it’s like he needs to ask for forgiveness to the U.S.

I would expect it to be a waste of an application fee, but I guess there is always some chance, no matter how small.

Yeah I hate to be a naysayer, but I think it's pretty unlikely that he could ever obtain a Tourist visa after having been though deportation proceedings. In my experience, if someone has been denied a tourist visa once, it's improbable that they will ever be approved a tourist visa in the future. So I imagine that for someone who has been deported it would be that much more difficult.

I don't know anything about requesting a pardon or if it makes a difference that he was a minor, but I also would assume that he would be in their database forever. I'm no expert though and it could be worth a shot. But he'll be out a hundred bucks if denied, so it might just be easier for you to come visit him in Mexico. Good Luck.

2004--2005 - Many subsequent visits to Mx ensue to be with my love; engaged in March 2005!

04/??/2005 - I-129F is filed from within the US

06/09/2005 - Zinker moves to Mexico

09/??/2005 - I-129F is approved

10/15/2005 - Interview in Cd. Juarez and subsequently approved for a K1 Visa!..But visa is left in Juarez

10/17/2005 - Due to unexpected pregnancy and a job offer in Mx - we decide not to pursue the visa and it expires :(

01/04/2006 - Married in Mexico

10/09/2011 - Two children later and a comfortable life in Mexico... Preparing to file I-130 in December 2011. Stay Tuned!

The application form requires you to list any prior immigration issues anyway.

You can try, but it's unlikely. It would be unlikely even if he had never tried to cross illegally, because he is a young, unmarried (from the sounds of it) male from Mexico.

08.06.2010 - Sent off I-485
08.25.2010 - NOA hard copies received (x4), case status available online: 765, 131, 130.
10.15.2010 - RFE received: need 2 additional photos for AP.
10.18.2010 - RFE response sent certified mail
10.21.2010 - Service request placed for biometrics
10.25.2010 - RFE received per USCIS
10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!

REMOVAL OF CONDITIONS

11.02.2012 - Mailed I-751 packet to VSC
11.08.2012 - Checks cashed
11.10.2012 - NOA1 received, dated 11.06.2012
11.17.2012 - Biometrics letter received for 12.05.2012
11.23.2012 - Successful early biometrics walk-in

05.03.2013 - Approved! Card production ordered!

CITIZENSHIP
