ello im new here my name is anis i meet my fiancé in September 2010 online and i know her for8 months and she is be here in tunis and i married her in Tunis and when i send the petition of K3 the immigration they said its illigal just because she have a last divorce in January for the courthouse and now im so confused right now what i gonna do plus she is pregnant

Question in our situation i can apply for K1 visa till my wife and me im not married in US ..

can i have to annul the mariage before to apply for K1 visa ???

can i see my wife beofre she is born in next june or they give me a B2 visa to see her when she is in labor

Answer me pleas ,,thank you

She has to file for a CR-1 for you.

You are married you cannot file a K-1.

Feb. 14, 2011 received hard copy of NOA for AOS, EAD& AP

Feb. 18, 2011 received appt letter for biometrics

Feb. 28, 2011 biometrics appt @10am

Feb. 28, 2011 received txt/email AOS case transferred to csc

Mar 1, 2011 AOS Touched

Mar 3, 2011 received hard copy of AOS transfer to csc

Mar 4, 2011 AOS Touched

Mar 28, 2011 Received txt/email saying card production has been ordered. (1month 3eeks 3days)

Mar 28, 2011 Received 2nd txt/email saying we have registered this customer permanent residence status

The marriage in Tunis would be recognized by the US - However - my reading of the above says that the US doesn't recognize the marriage - because she wasn't divorced properly prior to marrying you? Is this what you mean?

You could - if she isn't legally married to you for the above.

You can always try to get a B2 visa - but I wouldn't hold out much hope, seeing that you are trying to immigrate here with the failed K-3 attempt.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
