We are about to apply for the K1:

*He is from Netherlands.

*She is from the USA.

- Met in New Zealand during 2010 while on working visas.

- Lived and traveled together for the last year.

- In June, he bought a house in Phoenix, cash buy, paid in full. It is HIS property.

- Both of us have been granted Australian work visas for the next 12 months.

Here is the dilemma: CAN WE APPLY FOR THE K1 WHILE LIVING AND WORKING IN AUSTRALIA?

Will this effect the proof of support? He owns a property in the US where we will live and we will both be working good jobs in Australia? Will that be enough or does she need to go back and maintain a steady job during this process??

help! please :(

It may be easier for you to marry and then apply for a spousal visa. http://www.visajourney.com/content/dcf

The US citizen needs to have a US based domicile and satisfy the affidavit of support (for either fiance or spousal visa)

I guess we were hoping that the home ownership would do the trick, should we move the home into her name?

She is working a sales job in the US right now, but we hate being apart. It seems like this process could take up to a year. She has an even better job offer here in Sydney. We could be saving up so much money if she was to come down and take advantage of this other opportunity while we wait.

well, the sooner you get the K1 processed. the sooner you can go over.. it might just be less trouble..

i think you need to do more research on your options.. look at the GUIDES section.. everything thing is outlined..

just don't try to short cut the system.. every one of us hate being separated.. but its the eventual outcome we want :) you will need to be patient during this process

Read through the guides and choose the steps that you want to go through. With a K1 the wait for work authorization is several months. With a spouse visa the immigrant is work authorized immediately upon entry.

Property ownership is not a magic pill.

Yes her family can sponsor you if they meet the 125% requirement.

Also for everyone else to answer couldnt she work in Australia and do Direct Consular Filing using her Australian income? I dont know im just asking.
