Hey everyone

if my fiance and I have filed the petition for the K1 Visa am I allowed to visit him? I read a lot about that you are not allowed to travel because you could stay in the country illegal and the immigration officers could deny your visit and send you back home. Has someone of you visit the US citizen in the USA after filed the petition? Did you got in trouble? Could you stay or did you had to fly back home?

You are allowed to travel, there is no guarantee CBP will permit you to enter the US. If you are allowed entry, just don't overstay your authorized period of time.

September 2007: Met online via social networking site (MySpace); began exchanging messages.
March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online

December 9, 2025:  N-400 interview

bring as much paper work with you that you can with regards the process, NOA1 or NOA2 depending which stage you're at. bring ties to Germany, job contract, letter from boss, rental agreement, mortgage stuff, return ticket etc.

if they get funny with you just explain that you are going down the legal route to come to america, have no intension of breaking the law, you've already spent a hell of a lot of money so why would you screw it up, and that you just want to see your fiance for a while. you could always point out that you know coming on a tourist visa and staying is illegal and will only cause you trouble down the line and again refer to the point about already spending lots of money so why would you screw it up.

like Ryan H says, just don't overstay!! and be honest with the CBP people.

I'm sure you'll be fine just be prepared :)

hi,we filed in may i visited in september. we just go a RFE at the time. i flew to chicago. no issues at all. it went as usual. the only question that came up was: do u have a returnticket. i was never asked that before - but of course i did so no problems. he didnt even wanna see it. i brought some ties (letter from my employer stating when i need to be back at work letter from my parents). if i were u i´d go ! i think since beeing from a VWP country there shouldnt be an issue. just be honest at all time since i dont know if they know about the pending petition/visa or not. just dont offer information but be honest if asked

Germany is a Visa Waiver country for USA. You do not need a Visa to visit him. So as long as you meet the requirements for travel you can come visit for up to 90 days with no visa.

Sounds good. So far we haven't filed but it's good to know that a lot of people didn't get in trouble when they visited their fiance. So you told the officer that you are visiting your fiance, showed your NOA and than he asked for the ticket? That was very easy I would say.

Germany is a Visa Waiver country for USA. You do not need a Visa to visit him. So as long as you meet the requirements for travel you can come visit for up to 90 days with no visa.

I know that I dont need a visa for visiting him usually. But I read a lot of people that had been in trouble at the airport when they wanted to visit their fiance during the k1 process.

Sounds good. So far we haven't filed but it's good to know that a lot of people didn't get in trouble when they visited their fiance. So you told the officer that you are visiting your fiance, showed your NOA and than he asked for the ticket? That was very easy I would say.

hallo zurück :-) no i did not say that i was visiting my fiance and didnt show the NOA (i had it with me though) he asked the purpose of my travel i said "vacation". u´ll be fine. Good luck :-)
