Hi all!

I have a question as my fiance filled the form I 134 Affidit of support, the question 8: "The following persons are dependent upon me for support"...

He did not put his ex wife because he paid her maintenance for 3 years at once, 2 years ago, so he does not have to pay maintenace for still 1 year.

So the question is:

Does he have to put her anyway, or just put the current dependent persons (his children)like he did????

We are waiting for the interview soon, and suddenly we wonder.

My fiance put his child too because he pays child support, but what about the ex wife, knowing that he does not have to pay maintenance for still one year? Do you think he has to list her too?

No. Even if he was paying spousal support she would not be a dependent.

The only exception to this is if she was also a foreign woman subject to an I-864 which was still valid.

I am divorced too and pay child support. I put my son's name and checked that he is partially dependant. I feel this is correct in my case because the ex pays a part of his expenses.

There is no such thing as "partially dependent" for the K-1. He counts as a whole person no matter what you checked. The I-134 is used for many visas. For the K-1 ALL children under age 21 count as dependents no matter where they live or who pays child support, if any. UNLESS they are over 18 and emanicipated.

ex wives NEVER count as dependents unless they are covered by an I-864
