Hello my name is George and i have quite a complication you see the mother of my daughter lives in Honduras and my daughter was also born in Honduras. On her birth certificate she has mine and her mothers last names. But she has another child who is already 6 years of age but his father is not present and has not been present since his birth. The true complication comes that he does not hold his mothers last name on his birth certificate he has his aunts last name on his birth certificate. I want to bring all three to the united states but i am not sure where to begin.

Are you an American citizen? Since you refer to her as "the mother of my child", I assume you two are not currently married?

Are you a US citizen planning to apply for a K1 visa for the mother of your child?

Unless you spent most of your life outside the USA, your biological daughter is probably entitled to a US passport- you'd need to file CRBA (Consular Record of Birth Abroad), and she won't need a visa.

The other child: why is the aunt's name on the birth cert? Is it just the last name, or is the aunt also listed, falsely, as the mother of the boy on the birth cert? If it's just the last name of the boy that is different, then it shouldn't be a major problem to get him a K2 visa (child of a fiance)- if the father is listed on the birth cert, your fiancee may need a consent from the bio dad or a court order to take the child out of the country; this varies by country. If the boy has someone else listed as the mother on the birth cert, then that is more trouble.

Yes im trying to apply for a visa for her to come over here and as of for my daughter im more than sure i can get her into the U.S quicker than both her mother and her son..and her son is in custody of her aunt because she gave custody to her aunt but now she wants to withdraw the custody my main concern is getting the custody of that child because i want to bring all 3 of them at once i do not want to separate the family
