Hello VJ Geeks...

I got married on June 25, 2011. Returned back to USA in the end of July. As of now I am Legal Permanent Resident (LPR) and already processed for Naturalization (N-400). One step in the process, I received a letter from USCIS last Friday, September 02,2011 mentioning about appoint date for September 15, 2011.

Should I file I-130 for my Spouse ( wife) right now being LPR or Wait until get Citizenship?? If I file at this time, how it works to change my status of LPR to Citizen when I get it to speedier the whole process.

And you all guys know, the whole idea is what is the best course of action to bring her where I am at (USA) QUICKER as possible.

Hello VJ Geeks...

I got married on June 25, 2011. Returned back to USA in the end of July. As of now I am Legal Permanent Resident (LPR) and already processed for Naturalization (N-400). One step in the process, I received a letter from USCIS last Friday, September 02,2011 mentioning about appoint date for September 15, 2011.

Should I file I-130 for my Spouse ( wife) right now being LPR or Wait until get Citizenship?? If I file at this time, how it works to change my status of LPR to Citizen when I get it to speedier the whole process.

And you all guys know, the whole idea is what is the best course of action to bring her where I am at (USA) QUICKER as possible.

you can submit the i-130 now and upgrade the case with uscis once you become a us citizen by submitting the noa1 along with the naturalization cert. the nvc will receive the case as cr-1 which is eligible for immediate processing

I got that part. I am still wondering, what's the time difference in whole process if I file I-130 now and later update my case with USCIS being Citizen or wait until get Citizenship and then initiate filing I-130?? make it simple, let's say it will take 6/7 months to complete CR-1 process.If I submit the I-130 now ( Status : LPR) and update my case being citizen after 3 months then how many more months in general take to complete the whole process. Still 6/7 months after UPDATE my case or just another 3/4 months.

Not 100% sure (someone correct me if I'm wrong), but from my understanding, your I-130 petition for your wife will be processed by USCIS as per normal. The delay comes at the NVC stage of the process, when you are actually applying for a visa.

The difference between petitioning as an LPR and a USC is that there are only a limited number of visas available for immediate relatives of LPRs every year, whereas there is no limit to the number of immigrant visas issued to immediate relatives of USCs. Thus, an immigrant visa number will always be available for spouses and children for USCs.

Based on this understanding, I would go ahead and file the I-130 petition now.. since you will have to wait an average of 5 months anyway. Let USCIS get started on your file and cut waiting time later.

Hopefully someone more knowledgeable can come along and confirm this for you.

USCIS often process I-130s faster that will have visas available upon approval than those in the preference categories. There isnt any true difference if you will become a citizen about 3 -4 months from now. chances are the submitted I-130(s) will be adjudicated in about 4-6 months regardless of residency. There are i-130s filed by us citizens and lprs alike that toook 6-9 months to be approved.

as us citizen and without and case related delays.. on average our cases will be timely processed in about 7-9 months

File now for I-130 to save time.. I was able to save at least 4months.. :) waiting for my naturalization test & interview on the 12th and I already filed an I-130 for my husband last March 31st. and got an approval on July 20th..I will just upgrade from F2A to CR-1 once I get hold of my naturalization certificate. Goodluck!

i will start collecting all requirement documents ( ask her to sent mail with G325A) and apply I-130 as LPR and will upgrade my case when i get my Citizenship. My understanding is;there should be no extra documents required being LPR compare to citizen on filing I-130. If I am missing something, correct me.
