hi everyone i am finishing up some papers for AOS, and my question is about the form I-864 and I-864A. My brother was a co sponsor when my fiance came here and we both had to fill out seperate I-134, well from wat i have read on here I-864 is if my brother lives in a different place and I-864A is if we live in the same house, household and we do. But somewhere on here i found that somebody said its better to fill out I-864 than I-864A even if we live together... but didnt exactly come across why... now i am not sure what form should my brother fill out I-864 or I-864A ( once again we all live together, same household)..sorry if this question was posted somewhere already ...on my last income i made only 10,000 cuz of school... didnt work much.. if someone cld pls explain to me how that form works i will appreciate it

I couldn't find exact the thread I have read, but there were people recommended I-864 even though you live with the co-sponsor just to avoid a RFE. It said somehow people got RFE asking for I-864 form for your household member. Whole point was, be safe and prefered, you don't wanna get RFE.

There were so many info all over the web which made me confused as well.

I used form I-864A for my father in law who lives in the same house. Seems there had been no problem as the fact I got approved last week. I can't give you a legal educated advice, but I am happy with what I've done(I-864A).

08-09-2013: Service Request created for no ASC biometrics appointment

08-12-2013: Received response to the Service Request (pretty much saying to wait for 30 days)

09-10-2013: Another Service Request created for no ASC biometrics appointment

09-12-2013: Received biometrics appointment letter

09-12-2013: Case transferred to CSC (while phone voice record says its transferred to St. Albans)

09-24-2013: ASC biometrics appointment

10-03-2013: Case transferred and now being processed at a USCIS office<p>

(Online case update; no detail of where exactly it is at....)

12-26-2013: Case approved by local field office (dated 12/18/2013)

02-18-2014: No greencard after 60 days... Created service request

02-24-2014: Card production ordered

I-90 Replacement of Greencard (for legal name change)

05-06-2016 Filed i-90 online. Receipt number assigned immediately.

05-27-2016 Received Notice of Action (dated 5/24)

A separate I-864 is "cleaner" and easier to understand (it can confusing counting household members), but if you live in the same house a I-864a is okay too. With a I-864, the brother must qualify on his own, and for I-864a he can combine his income with yours.
