My youngest daughter and I will be traveling to meet my future fiancee and her daughter. I have already started filling out all the paper work. We want her daughter to take my last name when we marry but this is where i have questions. She was never married to her daughters father but her daughter has her fathers family name. Will she have to have his permission for her to immigrate with my fiancee? Will he have to sign something for me to adopt her so she can take my family name?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

It all depends on how old her daughter is. If she happens to be below 18 and is a minor , yes you need to take a signed permission from his father to take her out of the country. The father mus have acknowledged the legitimacy of her since she bears his family name. Changing her name can be only be done though legal process of adoption in which for sure you will be needing his signature. I suggest you let her go to the us without changing her name. Good luck.

We have to have his signature eventhough he does nothing to provide for her and doesnt even see her. Seems like that is unfair to her.

Yes you cant avoid that no matter how despicable it may seem. That's the very same reasons why i put on my daughter's birth certificate having the father declared as unknown. I have known about it and don't want myself caught up with all the legal stuffs. No sense of doing such if marriage didn't take.

I'm not sure how it works in countries other than the US, but I know here I legally changed my daughter's last name by going to the court house. They had me declare my intent to change her name in a public forum for 30 days (I chose an ad in the newspaper), and when no one challenged the name change, they changed her birth certificate to my last name.

It's tough, and I feel your pain, since my fiance would like to eventually adopt my daughter, but we're not sure what kind of challenges we'll face (not to mention, she doesn't have a passport and I cannot apply for one for her without the consent of her "father").

Depends on the country. She would have to be adopted and have a legal name change in the USA.
