The NVC has forwarded our petition to the Montreal Embassy of Canada on May the 10th. It has been almost been 4 months now without any sign on the packet 3. I have tried contacting my Montreal embassy by phone but they stated on a recording they have no operator assistance and have never received a response to my email sent in June.

The first thing I wanted to know was about the Approval notice, It mentions on our I-797 that it is valid from 5/02/2011 to 9/01/2011. Does this mean out approval will expire shortly or will it be automatically extended?

Secondly without having received the packet 3 I wanted to go through with sending off the necessary information, but I don't have a solid checklist of what I need to send. Do I need to physically send them back the packet 3 or can I still go through with sending gathered information?

Any help would be greatly appreciated.

I can help you only on your first question. I know that the embassy is able to extend the validation date of the petition if they believed you have a convincing evidence to get the visa. Since you are not yet interviewed, there is no any reason that the embassy can’t extend it.

You should have gone online to the Montreal website and got the packet from the website.

Had you posted in May in the Canada regional section of this VJ website, everyone would of told you to dl the form and you probably would of been living in the USA by now.

Get to it hurry and get the info on Packet 3 from Montreal website and get the papers to them.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

I ran into the same problem with the expiry date of my I-797. From what iv read at this stage it doesnt matter so much if it expires. just about EVERYONE who files through montreal gets theirs expired because montreal is so annoyingly slow! :bonk: and they dont look at the expiry date. from things iv read and from what i understand. As for your second question, im not 100% sure if u can continue without getting the packet 3 info. but i can help you to have everything pre paired and ready so when u DO get it you can jump right away to the next stage and send off your documents right away. i have my checklist here for packet 3 and i'd be happy to let you know whats on it and what ur gonna need to get and do and what forms you'll have to fill out. send me a message and i'll let you know what you need :)

I know in UK Embassy does not send out the packet 3 so listen to Inky. UK Embassy does it the same way.

7/15/11 Sent K1 Petition to Lockbox

8/10/11 STILL NO NOA1!

8/12/11 Called USCIS to get receipt number-NOA1 will be resent

8/16/11 Received NOA1 with date of 7/20/11

1/3/12 NOA2!!!

1/12/12 Got email notice we are through the NVC.
