Timeline

I know this is a dumb question, but what exactly is the difference between the CR-1 and IR-1. I am trying to use James Shortcuts, and I'm not sure which category we fall in.

CR1 - married under 2 years at time of entry - upon entry into the US you would get a 2 year greencard....

IR1 - married over 2 years at time of entry - upon entry into the US you would get a 10 year greencard....

Your process will be CR-1 process, if your marriage is less than two years old and your process will be IR-1 process, if your marriage is minimum two years old. When your spouse will arrive in the USA, he/she will be given either CR-1 status or IR-1 status depending on the length of your marriage at that time. With CR-1 visa, one has to remove the conditions as soon as the marriage is two years old. But with IR-1 status, there is no need to remove conditions. CR-1 status means conditional permanent resident status.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

The difference is the age of the marriage at the time the visa is issued. So you won't know which category you fall in until the visa is issued.

For the avoidance of confusion, there's only 1 process. The age of the marriage has no bearing on the process, the age of the marriage only affects the designation attached to the visa when the process is over.

Because "the process" is identical and there is no choosing which designation one has--you are, or you are notl. Simple. :)

Because, as meauxna also makes clear, there is no "option". There is no separate "CR-1 process" and "IR-1 process". There is the immediate-relative immigrant visa process, which covers CR-1, IR-1, and a host of other classifications.
