Yes you are still liable...if you did an affidavit of support (I-864) for her, you are on the hook for 10 years...it doesnt matter if you divorced or not. You would still be on the hook for g/f if you ever did an I-864 on her too.

Would it be possible to transfer the liability to my ex-gf (or her brother)? I only sponsored the mom... No one had the income at the time to satisfy the requirements, but her and her brother make well over the the poverty requirements now...

I'm just wondering what type of petition you did for your ex GIRLFRIEND's MOM? Is there such a petition for non-immediate relatives??

Not possible. It is a contract between you and the government.

The I-864 affidavit of support remains in effect until one of the following occurs:

1. The immigrant accumulates 40 quarters (10 years) of work credits through Social Security.

2. The immigrant becomes a US citizen.

3. The immigrant loses their LPR status and leaves the United States.

4. Either the immigrant or the sponsor dies.

If none of the first three events ever occurs then you could potentially be "on the hook" for the remainder of your life.

The contract becomes binding and enforceable when the requested immigration benefit is granted. You can't transfer sponsorship to someone else after that.
