Timeline

I apologize if this question has already been answered, however, my wife and I are about to send of our I-485 and need to make sure we have filled out our I-864 correctly. We only want to fill out the mandatory fields as we feel the optional fields regarding assets amount to TMI. Therefore, we've enclosed her three most recent tax returns, where the gross adjusted income is as follows:

1st most recent: $24,318

2nd most recent: $32,580

3rd most recent: $24,375

As 125% of the poverty line for 2011 is set at $18,387 for a household of our size we trust this is sufficient? Her true salary is actually in excess of $30,000 however, she uses all available credits and deductions on her tax return, the total adjusted gross is always lower. I think t his should be evident from her tax returns and to back t his up we've enclosed a handful of her most recent pay stubs and a letter from her employer.

Since the figures alone exceed the poverty lines, does everyone think this will be sufficient?

Gross will be higher than net. She should only be using the gross number.

Timeline

Current and continuing income is what is measured unless the sponsor is self employed. If the sponsor's present annualized income meets the requirement then you ought to be ok. For a wage/salary earner use the gross wages.

You've kinda hybridized the IRS tax terms when you say "total adjusted gross".

You might be using the wrong line. Get the numbers from Total Income, which is line 22 on a form 1040. It's BEFORE adjustments are deducted. You do not use numbers from Adjusted Gross Income line 37 (or 38).

Thanks guys! The I-864 is so confusing. We thought by adjusted gross it meant as per the very bottom of her tax return. An we just mailed it before reading that last post :( I'm trusting that it will be ok... they will see the tax return and realize we used the wrong line on the form.
