On the G-325A form, concerning the section about the Applicant's residence last 5 years...If my husband spent 4 months in Costa Rica (and worked there) in 2005 and then spent another month there in 2007, does that qualify as needing to be explained in this section of the G-325A? Or would his residence be continually seen as his residence in Nicaragua?

Thanks san diego!!

I have one more question for this form concerning the employment section...my husband's cousin "sold" his commercial type truck to my husband. My husband pays monthly payments, but the truck is not actually in my husband's name and will not be until he pays it off. My husband manages the truck, repairs it, and has a driver and workers, so it's as if he is the owner, except on the paperwork. I say all of that to ask if I would put his current job as Owner of the truck. If not, then I will put "None" as his current employment....

hello! Where did you find out that visiting over 6 months counts?, if i may ask. or do you mean "legal residence of 6 months or more "....I was wondering about that question myself, having spent alot of time in Costa Rica, just under a year on one visit. I figured, my "residence" to still be in the US, because I am not a legal resident of Costa Rica.

Actually, if you visited country for more than 6 months you have to mention it in your past addresses. Up to 6 months is considered visiting. More than 6 months is considered "temporary residence". I can find link for you if you like.

I meant 6 months at a time. If you are US Citizen and in one visit spent over 6 months in Costa Rica, you need to consider it as a legal residence (6 months without returning to US or leaving the country).

This is a tough one. His ownership of the truck is irrelevant. What is relevant is:

1) Does he make money by using the truck? Does he provide commercial services?

2) Does he have commercial entity that provides such services with physical address and phone number?

3) Does he pay local taxes?

In this case ownership of the truck is irrelevant as his relative can provide the letter explaining it. However, if he does not have any of the above ownership of the truck becomes irrelevant

wow..thanks.....i would love the link! I was sending off my I129F package tomorrow.....incomplete it seems.. lol........phew.. I was confused especially seeing how it's so difficult to become a costa rican resident.......I even had a daughter born there, it would still take a long while and tons of paperwork for me to be a legal "resident" otherwise, you have no legal right to work...cant even get a cell phone in your name.........guess thats why i stayed away from claiming "residency" in CR on that form.......

This is a tough one. His ownership of the truck is irrelevant. What is relevant is:

1. He does make money by using the truck by providing commercial services (transporting salt, rice, soap, etc).

2. Sorry for the ignorance, but I do not understand commercial entity very well!? He does have documentation in the company the truck works, if that's

what you mean!?? I do not think it's government official, but just a way to keep track of his truck and so they can pay him.

3. He does not have any local taxes he pays, I'm guessing because it's Nicaragua!?? He does have to keep insurance on the truck and the driver.

Would we need a letter from the relative at a later time during the visa process for the explanation? I ask because his relative actually works in Carnival Cruise and will be leaving Nicaragua next week, so I want to make sure and get the letter, if it would be needed.

Have you spent non-stop more than 6 months? You were not costa rica resident, legally. You were "residing" there. There is a difference. All they are asking about is "your residence address" of more than 6 months. I will try to find actual documentation and will send it to you. Basically, in any country you can get tourist/visitor visa for no more than 180 days at a time. Everything above that is not considered visiting. Given that you were in the foreign country continuously.

I think that's the route I'll go as well, especially since he was only there 4 months....All the paperwork starts to get confusing when you are so anxious in the first place! Good luck on your journey!!

I will clarify using the form DS-230, which needs to be filed after I-130 is approved with NVC.

In form DS-230, under Item 30. "List below all places you have lived atleast for 6 monthssince you reached the age of 16, including the places in your country of nationality. Begin with your present residence", you will have to fill all the places of residence you lived at least 6 months.

The alien's G325A needs to be same as the details in DS-230, so include only places you lives atleast 6 months continuously (don't add broken periods) in G325A.

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

i did struggle bout that too..cuz i just move in dif place now..so me and my husband wondering what should we put my old place or my new place now,cuz i been staying here for 1 month now..so we call the ucsi and the one we talk there told us i will still put my new address now..so i guess just put your hubby address now..
