Hello,

I will be mailing out our cr-1 petition in a few day. I was talking to a friend and he mentioned to me about imbra and that got me a little concerned. I am wondering if my wife and I should be concerned about it. I'll give the details to hlep. My wife and I met through a dating website in Oct 2010 it is 100% free to meet and chat with members. www.findloveasia.com I traveled to China in May 2011 and we were married in June 2011. I am concerned because a lot of people are saying lots of different things about imbra. Some say it only applies for broker sites, some say imbra isn't applied if the site we met through is free, and some say imbra isn't applied if we are married. Thank you for any help and insight about this, and sorry to likely beat a dead horse.

You may want to read a bit about filing petition when beneficiary is in China. They want a Evolution of Relationship document - basically you write how you two met, list any red flags and write down how you overcome them. So, if she doesn't speak English well - you provide evidence how you communicate...

I am sure other VJ members with spouses from China will come along soon to provide more input.

One of the first acid tests that I'd use, for IMBRA, is to see if the site has any posted IMBRA notice, anywhere.

in a google search box, enter

site:findloveasia.com IMBRA

nothing came back.

IMO, since the site has no IMBRA statement, USCIS won't bother about it.

Do suggest you have EOR in yer I-130 submittal, regardless.

findloveasia.com Shouldn't have any issues with IMBRA. IMBRA is basically concerned with brokers who you pay to find you a wife. Dating sites, even paid ones aren't guaranteeing anything, just providing profiles for you to peruse and you must initiate contact. As long as you aren't going through someone at the site to make contact and to pass your messages back and forth then you are good. I believe the site is supposed to make a statement about being a marriage broker if IMBRA applies, but don't always count on that.

Do definately write an EOR letter and when time comes for the interview, update it and get that notarized. Do have pictures with your wife's family as well. These are the main things the VO seems to look at. If you have been divorced, include an letter explaining that especially if there was a visa petition involved.

As for all the IMBRA doesn't apply comments, take those with a grain of salt. IMBRA applies when there is a matchmaker involved. Doesn't matter if the site is free or if you are married. If there is a broker or matchmaker then you need to be concerned.

Hello,

Thank you for the quick responses. I didn't think there would be a problem with imbra but I just wanted to double check. I don't really see any red flags in our case.

I'm 26 years old and a senior in college.

My wife is 22 and finished with college as an english translator.

Our relationship wasn't short before we married. 8 months from first meet to married.

Her family loves me and we have some good pics of all of us together.

I am planning on going back in December for the ceremony and there is a good my parents will go too, I hope it helps prove we are a real couple. Thank you again

8 months isn't a long time but not a problem really. Your parents at the wedding will be a huge plus IMO. Good luck with the wedding
