:help: how important is the employment letter as supporting docs to I-134F? My fiance' have a problem with his company's HR..they don't want to give him the said verification letter..they said its because of the information laws in the US..they could not disclose the information of their employees as they might be sued.. :crying: is his current pay stubs will suffice?

Position held, start date, salary and whether is a permanent or contract position are "disclosable", that is the kind of info that might be required by a new employer if she were to change jobs.....The HR people are often clueless on this. If she states the purpose, she should be able to get letter...I had similar pushbacks from my HR, and I insisted all the way to the Director. I have my letter...

Pay stubs and IRS transcripts (free, just need to request them) should suffice

The previous poster is correct. This is all information that they can disclose and I don't believe they even need your permission. What they won't disclose is performance history as they can and often are sued for this. Start date, current salary, position and type (full/part/contract) are all ok. You will just have to push the HR people for this. If they won't give it then he can talk to his manager to get it.

When I was getting my passport renewed, I was claiming lost or stolen, my consualte asked me to go to the police and get a report done. I did, and the officer wouldnt do it, as it wasnt a Canadian Passport. I went back to my consulate, and they said I had to attempt to prove that I had requested it and sent me back to the police to get a letter stating that they wouldnt give it to me. Well, they wouldnt give me the letter either. So I took his business card and had him write his police ID number on it. I sent a letter to my consualte showing the phone numbers I called, the dates and time I talked to anyone, the fact that the officer wouldnt give me a letter and I submitted his business card.

Sometimes you just cant get the things you need from others, but at least try, be thorough in your explanation letter, and ask you HR person for her card and tell her youre submitting it to Homeland Security because she wont give you a employment letter.

Also for my AOS, we didnt send in a employment letter, it was a contract dispute between 2 companies and it was complicated as to whom my husband really worked for. We sent in a explanation letter instead and 6 weeks worth of paystubs. We never got an RFE for it.

I hope this helps in giving you some ideas on how to get around the letter that you cant get.

employment letter is optional on the I-134. Paystubs can prove up current income and sometimes employment history.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Something that might help is for him to write the letter (stating what the I-134 instructions require) and then just have this manager to sign it after getting it in company letterhead (have a flash drive to easily do it at that moment).
