My fiancee and I went to the US Consulate and were told that we needed to contact the immigration IV team via email. So I did scan my fiancee's temporary residency paper and also decided to drop a copy at the US Consulate mail box.

The US Consulate in Montreal just sent me an email showing the front page of the Packet 3 being sent to my Fiancée. So I guess they have accepted it as proof of legal residency ouffff!

I still have a problem with the passport though. My fiancée talked to her Canadian immigration lawyer and she stated that the only way they can give her passport back is by withdrawing her asylum claim and if she does that she will be given 30 days to leave Canada.

If withdrawing her asylum will automatically disqualify her for the K1 visa then it’s not worth it. The US consulate is aware of her asylum situation.

Is there anyway she can go thru the interview process without the passport on hand? I mean she has a photocopy of the Bio page but the passport is still seized.

Has anybody been allowed to go thru the interview without a passport then brought one after the visa was approved in order to attach the visa? If you have run into this situation please let me know.

Without a passport there is no place to attach the visa. So at some point the passport will have to be produced to obtain the actual visa that will be used to enter the US.

Follow up as you were directed with the Immigration IV team. That sounds like the best source of information for you.

As I have suggested elsewhere, the passport is required to affix the visa but it may not be necessary for the interview. If she is approved at the interview then she would be able to withdraw her asylum application, obtain back her passport and submit it to the US Consulate for the visa. If there is a delay or she isn't approved at the interview, then her status in Canada remains safe while you two address what needs to be addressed. The last thing you want to have happen is to have the asylum application cancelled, have the passport in her hand for the interview - and be put on AP or given an RFE or some other delay for the decision. So, you need to be prepared to explain why she doesn't have her passport in her possession - but she does have one and will be able to produce it if it is required for the visa.

Thanks guys I will send an email to the US consulate in Montreal to see if they will let her interview then produce the passport after the K1 visa is approved. I just hope they don't get prejudmental because I told them this??? By the way how long does it take to receive the packet 3. They sent me a copy on my email with a June 30th date on it. I understand we had Canada day on July 1st and US independence day on July 4th but we still haven't received it yet? Is that normal How long does it take to get the packet 3 in Montreal?
