K-2 "follow to join"

My wife (K-1) received her visa back in September 2010 and now we would like to start the process for her son to join us with a K-2 visa. On the original I-129F and other forms her son was named but how do we start the process before he "times out" in September?

What do you mean by "times out"? Do you mean that he is going to "age out"? ( Turn 21 in September?)

If this is the case you have a serious problem. You must get him here AND get his green card IN HAND before he turns 21. I know this because I had the same issue. I managed to get it done with 1 week to spare but I had 7 months. You have 2 (plus or minus). You need to expedite. Does your wife have a green card yet?

They can follow up to a year of the K1 is what he is talking about but I am not sure of the process I hope someone else will know for you

Yes, I understood the question, What you're missing is the part about "timing out" (aging out). If his wife's son is turning 21 in September, he has a huge problem with no easy solution except to try to expedite. As I said before, this is not a theory on my part, I had had to do this myself.

My wife's son is now 16 years old but the window for the K-2 is good for one year after the date my wife was issued her visa, September 25, 2010. I would like to initiate the "follow to join" process and complete it before the one year is up. What I'm not sure of is how to start the process for her son's K-2 visa.

Oh good! I was worried you had an aging out situation. In your case you should contact the embassy in the city your wife used and they can give you the procedure, each embassy is different. You can also post this question in your regional forum, I bet someone there has experience with your embassy.

I hope you got your answer to this and that your step-son didn't "time out."

My process (ongoing) was to file an I-824 (download from USCIS website). Once this is approved (took up to a whole month with mine), they will notify you (meaning your wife as the petitioner) and the US Embassy where your wife is from. Then your step-son is supposed to expect a US Embassy packet any day after that about what to do next, and the documents needed.
