Hello All,

Is there a time limit to file the AOS after the marriage? We went to get a ID for my husband and they told me he couldn't receive one because his visa expires in Aug. Does anyone know if that's true

his visa has already expired, a K-1 visa is a one-shot deal - that last date on the visa was the last date he could come into usa

pay attention to the I-94 date, get married prior to that expiration, and yer golden.

suggest to go for ssn soonish, at ssa office, instead.. bring passport, ask for SAVE database lookup in A# or NAME, if they find him, proceed with the SSA application. If they don't find him, come back in a week, try again.

re: what you were told: sorry, they not know how to read a k-1 visa.

Most states require an EAD or a greencard, the K-1 visa stamp itself is mostly worthless for any state ID.

re: filing AOS - file as soon as you can, is no regulation on it, but the sooner you file, the sooner he'll have a greencard and the sooner he'll be able to participate in polite society.

Thanks so much for your response. We were married June 17th the second date on the I-94 is August 3rd. So basically everything is ok until we file the AOS? Which will be in the next few months

What state are you in?

If you have the K1 visa stamp and the marriage license along with social security card and proof of address you should be able to get a state ID. A receipt for AOS could also help. We are going through this now. OF course it varies by state and by the person at the counter. We were told that our request was sent to the higher authority in the state capital for approval before they would issue it.. a big pain, but still try again.
