EMERGENCY AP NEEDED, DIDN'T FILE I-131 WITH AOS APPLICATION

Hey Everyone!

Im in a major head scramble right now.

My husband needs to go back to his country becuase both parents are very ill.

we have the documentation from the doctor about his mothers condition etc.

BUT, we didnt file the initial i-131 with our AOS application because we didn't think we would need it.

NOW, we have to go get an emergency AP.

Qestion--- Will i have to pay extra for the emergency AP if ive already submitted my I-485 and paid the 1010 in fees and didn't submit the I-131 initially?

and-- what type of chance will we have getting it issued the same day?

Make an infopass appointment and try. No one can really guess if you will get one or not its up to the person you see at the infopass.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Yes, but do you know if we will have to pay extra for an emergency AP-- (outside what was paid for in 1010 for the I485)?

Bring your NOA1 from AOS. They shouldn't charge you because your not asking for an AP card your getting a stamp. But can't be certain it is up to the person at infopass as to what happens.

The fee for AP is waived when filed in conjunction with a I-485. Even though you didn't apply for AP at the same time, the fee will still be waived because the reason for getting the AP is still "I-485 pending." THe difficulty lies in getting the emergency Ap at the infopass, don't worry about the fee :)

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!
