O.K HERE, man and an ex-wife having share custody with this child. age 12 years old. ex-wife gets 65 percent of the child's time, and man gets 45 percent spending time with his son. now ex-wife petitioning to get more money from this man a more child support. now this ex-wife, got fired from her job, now she's staying home, she don't wanna work, she has a boy friend "engaged", and paying all her bills, this ex-w doesn't have a source of income, man believe cuz she's not working. the child said this ex-w gets a government help: food stamp and trying to get financial assistance from the government den she's working this child support to get more money from this man. man got a letter from the department revenue/child support that their asking for man's financial affidavit of support for child support review . this ex-w known as a alcoholic, smoker/pot, mentally abused this child by yelling etch. this child doesn't wanna be with his mom.

now my questions: does the current spouse of this man is responsible for child support to his previous child?

: do they basing the financial assets by house hold income? man and current wife's income?

: does she's gonna win with his battle?

help! man and the current wife lots of bills, house hold income doesn't enough to pay the bills. now this ex-w want more money from these people.

o7-08-08--AOS case transfered to CSC

o7-11-08--AOS case pending at CSC

o8-07-08--EAD Card Production Ordered today!CRIS

o8-14-08--AOS touched

o8-15-08--Email from CRIS Welcoming for a new resident in the USA

o8-15-08--Email from CRIS EAD notice approval

o8-15-08--EAD card arrived in the mail, EAD was approved in 70 days.

o8-18-08--Received hard copy of WELCOME LETTER as a new resident in the USA

o8-25-08--GREEN CARD Card Production Ordered

o8-29-08--AOS Approved! without Interview

o9-02-08--Received GREEN CARD with out INTERVIEW, with out RFE.

Timeline

Family court determines the amount of child support the non-custodial parent must pay based upon a formula which you may find by Google XXXX (your state) child support guidelines. It should provide a worksheet where you plug in the income for each parent, not the income of spouse, boyfriend, etc., and based upon a formula it will determine how much the non-custodial parent is obligated to pay.

The mother's state or ability to care for the child is irrelevant at this point as she has already been awarded custody, unless the father wants to file a motion for a change of custody and wins. I can assure you this will cost much money in attorney's fees with small chance of winning a change of custody.

This can affect you when it is tax time, if you file joint and he owes child support they can take any tax refund due for both of you and apply it to the owed child support.

Here's the deal. As a Rule Man in the USA gets screwed on Child Support and Child Custody, always a uphill battle.

I don't know what state you live in, but if it's a community property state like Texas. Then you and your husband can sign a pre-marital or post- marital agreement, that way in Child Supoort and Child Support payment your income can't figure or be included on the Child payments to his ex wife.

Without Pre or post maritial agreements then your income can and will be used to help her earn more money

basically the child's parents are responsible for them...not boyfriend, new spouse, room mates etc.... Just the parents so typically the income from only the father and mother are included in the calculation of child support. The new wife/husband's income is normally off limits to child support calculations.... Same as if it were reversed if she got remarried they wouldnt recalculate child support based on the new spouse's income.
