Received a letter from USCIS that we must fill out a I-601 waiver form because a mistake was made 8 years ago on my husband's passport and he tried to get it corrected, but no luck. The form asked for hardship affadavits explaining why it would be a hardship if my husband had to travel out of the country. What do we do and how do we proceed? Any suggestions?

A hardship waiver is a packet explaining why it would be a hardship to you, the US citizen, to move abroad to be with your husband, or for you two to continue living seperately.

We need more information:

- You posted this in the fiance visa forum, but you talk about a husband, and your profile says adjustment of status- which step are you at? Is your husband in the US or Nigeria?

- What exactly was the issue with his passport? Did he alert the US officials to it or did they find out?

- Did he apply for a US visa before this one, and what happened?

A hardship waiver is difficult, especially if they allege material missrepresentation as they might, depending on the issue with the passport, and you may want top consider a lawyer.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

We need more exact info. Is your husband in the states ? Is he adjusting status from a visa ? What kind of visa and when did he enter ? When did you marry ? What was the "problem" with the passport ?

This will not be over quickly. You will not enjoy this.
