I would steer clear of this guy. Your chance of immigrating to the U.S. with him is slim to none as things stands now. Deliberate hiding or falsification of a material fact is material misrepresentation and will bar you from the U.S. for life if you're a part of it.

Hey, from what I understand from the original thread of the OP, she felt frustrated her application was denied after all these evidence her fiancee had submitted. The adjudication of AWA immigration cases so far do not have a transparent standard. Some people here got approved while others don't. The OP's fiancee might not have known which evidence to submit or which evidence does matter in this adjudication. That does not mean that he was deliberately falsify or mis-representing information. Her application was denied due to evidence submitted being insufficient to convince USCIS (according to the unreviewable discretion of USCIS). That has nothing to do with falsifying. The important thing here for the well-being of the beneficiary is that she fully understands the criminal background of her fiancee. Also, whether the fiancee submitted any record of his DUI to USCIS is a matter of relativism. That is not related to a specified offense against a minor. And from the alchohol treatment paperwork that Letanni mentioned, I think it is pretty convincing that her fiancee was proving to a degree of his rehabilitation.

Insufficient evidence (subjectively decided by USCIS) does not equal falsifying/misrepresenting.

Also according to your statement of "steer clear of this guy", you sound like you were saying that the OP only cares about immigrating to the US. That is irrelevant to her original question of asking for advice on legal pursuit. There are actually people who come to the home country of the beneficiary to be with them. I have been reading the blog of that couple for a while.

That is irrelevant to her original question of asking for advice on legal pursuit. There are actually people who come to the home country of the beneficiary to be with them. I have been reading the blog of that couple for a while.

I also had an impression of the advisor seing the situation more under the perspective of immigrating to the US per se, rather then being with the petitioner by immigrating here.

This week my fiance has received the police report that says he is out of sex offender website. Is it helpful for our case later?

No, being removed from the SO Registry has no impact on falling under the Adam Walsh Act.

Hello All,

My case has been denied due to Adam walsh Act. The 2 main reasons are that my fiance didn't provide the proof of 3 years of counselling and 2nd is that his D.U.I.We have submited all the evidences to prove my fiance doesn't posk risk to me, However, my fiance didn't submit 3 years of counselling as it was a part of his sentence. He was convicted of possession child porn 10 years ago. He aslo submited the evidences of alcohol treatment..I dont undestand why they still deny us? What should i do now ? Should we appeal now? Please show me how to contact with human rights group and ACLU? I'm so panic and deeply sad. i love my fiance till death. Please anyone there help us? Please Please Please

In all honesty You and your fiance have an uphill battle and our prayers are with you. Contrary to the innocent till guilty shtick your fiance will need to provide over bearing evidenciary he is a model citizen.Get a top notch attorney on the job ASAP, no advice or the wrong advice can and will hurt you in this case!! In America anything listed under "sex offender" is a scarlet letter no matter what it is (unless you are Bill Clinton or Mark Folley) . Politicians are getting elected by leaps and bounds on offender registry's laws and restrictions, and money is being made hand over fist, the constitution be damned.. Murderers, drug dealers, politicians,thugs,and wall street, are the acceptable and approved forms of criminal activity..
