My Chinese wife has not made me happy. I am convinced there is no future with her. Is there anyone out there who has divorced their wife before their 10 year green card and what were the consequences. Additionally, my wife does not want to grant a divorce thinking it will be a problem for her to get 10 year green card after divorce. Any info would be greatly appreciated. I am getting mixed info on form 864? Please give me your opinion. Thanks, chaz3414

If thats the form number for affidavit of support, heck yes your on the hook for it.

Did you not read the contract portion of the form ? The part where you and the US government entered into an agreement together ?

If she goes on, I dont know what you call it here, but we called in welfare, or food stamps, or whatever service she needs from the government in order to survive. The government can come back to you to repay what she took.

Also I believe there is a clause in there that states she can sue you personaly.

Im not sure of the specific legalities here. But you did bring her from another country, and you are responsible for her.

Dec 25 2009 officially engaged

March 2010 - sent off I-129F

March 27 2010 - Vermont receives package :)

April 3 2010 - Informed through mail that cheque is cashed NOA1

May 28 2010 - RFE notification ( yeah Im online checking alot >.< )

June 5 2010 - RFE hardcopy received

June 18 2010 - RFE returned ( had done it June 7 - but USPS returned grrrr )

--- case says we should hear from them in 60 days from June 18 ---

June 23 - Touched

Aug4 - Email notification of NoA2 :)

Aug. 10 - NOA2 Hardcopy received

Sept. 13 - Faxed off Package 3

Sept 14 - Interview notification set for Oct. 5

Oct. 5 2010 Interview Passed

March 17 2011 POE Canadian/US border

April 1 2011 Marriage

Mailed AOS June 1

Chicago Lockbox confirms delivery June 3

Check cashed through bank - notification June 9

Getting divorced does not negate your I-864.

in most states an LPR cannot qualify for welfare with less than 5 years residency. if they give it to her with less than 5 and the rule is record of law it is on them. post your state of residence for more detial.
