Hey VJ,

My fiance is applying for a K-1 visa and I have to submit a Form I-134, Affidavit of Support. I would like to know what documents I am to attach to the form. I know the instructions ask for specific documentation from my employer which I was able to obtain. My problem comes where they ask for specific information from my financial institutions. I am able to get my bank and investment statements but it's just not in the format requested in the I-134 instructions.

Has anyone else run into this problem? If so, what did you do? Also, if there are people with approved K-1 visas out there what did you submit with your Form I-134?

I was able to get it in the format it states (amount of deposits in the past year) at my bank. Usually the people that work there off to the side in the little offices will sit down with you and write a letter. It takes a little while for them to go through all of the info..in some instances they won't have access to the information for a few days. I'd go in and ask them for what you need. The man that helped me had written those kinds of letters before..Also include pay stubs (I'm giving my fiance more than he probably needs), past 3 years of income tax transcripts which take about 10 days to get delivered to you from the IRS..I think you only need 1 year, I have to look back on the paper I don't have it in front of me..so double check that or someone can correct me.

11/18/2011: NOA1

4/20/2011: NOA2

7/13/2011: Interview!-Approved!

10/29/2011: Wedding :-D

Since my salary was over the poverty limits required, I only sent past three years of tax transcripts (free from the IRS), letter from employer and copies of three most recent pay summaries.

08-30-2011 - AOS/EAD packet sent

09-12-2011 - NOA1 for AOS/EAD with 09-08 notice date

10-11-2011 - Biometrics appointment (appointment letter received on 09/19)

11-03-2011 - EAD card production request

11-14-2011 - EAD in the mail

12-08-2011 - Interview date (e-mail notification date 11/08) APPROVED!

12-13-2011 - Card production ordered

12-14-2011 - Card mailed to our address

12-17-2011 - Got gc in the mailbox! Valid until 12/13/2013 <wonderful christmas gift>

At our interview in Kingston, they only looked at my three years of tax transcripts. I also had a letter of employment and recent pay stubs ready if they needed those as well.

Hmm... I am confused.

@Sus- you're saying they'll ask for 3 years tax returns for i-134 on a K-1? I was under the impression (per the instructions) that you only need a copy of the last income tax returned filed ONLY IF you are self employed. If not, only A and B (see the instructions: http://www.uscis.gov/files/form/i-134instr.pdf) were to be adhered to? (I did give my last tax return filed just for extra info though) but I am concerned if it will be enough?

And I thought the K-3 is what required 3 yrs tax returns? But Travel State says:

The sponsor is required to submit an IRS transcript or photocopy of only the most recent Federal income tax return with the I-864. However, the sponsor may, submit Federal income tax returns for the three most recent years if that helps establish his or her ability to maintain the household income required in the poverty guidelines. The consular officer determines if the income claimed by the sponsor meets the poverty guidelines. If the claimed income does not meet the poverty guidelines then the consular officer may additionally request current year income information.

In addition my employment verfication (detailing salary), three pay stubs, last three bank statements (with bank verification letter), and 401K quarterly statement. I don't want to hear a blessed thing about insufficent financial documentation lol

Brownie you sound WELL PREPARED!

I didn't file taxes for years prior. I was in grad school , not working at all. Do you think it is a good idea to send in a letter stating this?

They already have the last 6 paystubs along with the letter from my bank about my MMA, etc. ... I just want to make sure I have enough.

This is very helpful. I am able to get bank letters from just one bank. The other financial institutions line ING and Smith Barney will not give me a form letter. Is it ok just to bring in bank statements instead? Or is there a way to get a form letter from these institutions?

Mo you're right! its nosey dem nosey LOL...Bea, double check ING Direct -- they sent me the a notized letter with all of the required information in less that 4 hours (via email). They will send is US postal mail if you'd like. They were the fast bank in regards to getting me the needed information. Best.
