I'm about to send my AOS envelope and I want to make sure I'm not missing anything.

I came on a B2 visa in 2007 and I'm currently married with a USC for 4 months.

That's what I'll include:

- I-130 form

-USC Birth Certificate

-Certified copy of marriage certificate

-copies of joint credit cards

-copy of joint bank account

-Lease agreement with both of our names listed on

-Health/Dental insurance copy

-Affidavit from USC Father about marriage

-Biographic information form with 1 photo for each one

-I-485

-2 identical photographs

-Copy of foreigner birth certificate

-Certified translation of foreigner birth cert

-Form I-765 with 2 identical Photos

-Sealed envelope with form I-693

-Form I-864

-Original Tax transcript for the most recent tax year(2010)

-Employment letter for each job of USC

Each of the forms will be submitted with the correct fees and with cover letter,I still not sure to put my unauthorized employment on the biographic info or not.

Any suggestions on opinions on what I'm sending will be greatly appreciated.

Yes, you must include it. They will see if you have paid taxes etc. They will want to know how you have been supporting yourself, and it is better to work without authorization than be, a drug dealer, for instance. Your illegal work will be forgiven because you are married to a USC but you must disclose it. You also need to pay taxes on it.

The only possible issue is if you lied and said you were a US Citizen in order to get your job.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

Yes I do pay taxes since 2008 and no I did not claim to be a USC to get a job I simply used my temporary Driver's licence(now long expired) and

my ITIN document,I been with the same employer since then and filled my taxes for the years of 2008,2009 and 2010.

One more question,Am I suppose to include my tax transcript too?Because from what I understand they only consider my husband's taxes right?

Thank you a lot!

Like Harpa pointed out - immigration would be getting suspicious if you don't mention your work and wonder how you supported yourself, might assume you did illegal activities drugs, prostitution etc. .....

I was going through some rough times myself during my separation from my first wife and had to work to stay upfloat without green card or EAD - I did disclose it in the paperwork but didn't include my W2's, tax returns (those are evidence of your sponsors aka spouses income) but brought them to the interview just in case. The IO saw the work listed and asked if I am currently employed, though having the EAD I wasn't and the IO skipped to her next question.

So yes, working without a permit (unless you stole somebody's identity, got someone elses SSN or represented yourself to an employer as a US Citizen, green card holder without having one) is forgiven when you marry a US citizen.

Good luck on the your AOS journey!!
