Just a family question here. A family friend is sponsoring her paretns to come. They have been through the process and everything. They have two kids. One is 19 the other is 21. both girls. Can the children be added in. the daughter is sponsoring her parents. Or is it too late now that her parents have been approved at the embassy. the dad is just waiting for pension before leaving for america.... Both daughter will be left with the pension but on their own....

K-1 Visa Timeline:

02/11/2011 - Engaged at her house by her Godmother.

02/18/2011 - Engagement party with relatives - propose in Visayan.

02/24/2011 - K-1 packet sent.

09/18/2011 - POE, Viva Las Vegas, Baby !!!!! Home to Phoenix.

12/10/2011 - Official Wedding

07/05/2012 - Princess Rose born.

07/07/2012 - AP/EAD received.

07/17/2012 - AOS passed. (Birthday for Mama Rayos)

First there is no derivative status for Immediate Relative Immigrant Visas so the parents children (the petitioner's siblings) never could just be added to the parents' case(s).

Second the petitioner would have to petition for the siblings or the parents could do it once they become US Citizens but both preference classes have wait times for Visa Numbers to be available in the 10 plus years range.

ok, so I take it I am misunderstanding then. I thought as minor chilred, then chirldren could be added into the petition for the parents from the daughter. But this is not the case? Even though the daughter is petitioning for the parents, the chilren, even though minor, have to be petitioned separately? There is no way the minor children can be added in?

not when it's the daughter petitioning her parents, her siblings have no derivative status.

Note: If your parents have minor children abroad, those children (your siblings) cannot be sponsored on the same petition. Not to mention that 19 & 21 years of age aren't exactly minors!

:yes: the 19 year old will age out before a parent could become US Citizen, so will not qualify for immediate realative.

they'll have to wait in line for a visa and it's a long wait.

Because of the backlog it is about the same time for a sibling petition ( over 20 years ) as it is for the parents to become USC and file ( 5 years plus 15 years ) so you may want to apply now and get the ball rolling ( crawling actually )

This will not be over quickly. You will not enjoy this.
