Alright fellow VJ'ers,

I am currently living in Mexico with my wife under a tourist visa. Under those conditions I had to file with USCIS as if filing from inside the US and thus am managing all correspondence through my house in Texas and directing my father in what he needs to do with all of the mail. As many probably know, the mail system here in Mexico is complete garbage, and private couriers (Fed-EX, DHL, UPS etc.) can get downright expensive. I got my electronic notice of USCIS case approval on Monday morning, and although the case hasn't even arrived yet with NVC, I am trying to round up all of the paper work to get a jump start on it and get HOME. I am not currently employed in the US, so my father is going to lend me a hand with the I-864a. Both of us need to sign the document. I don't really want to spend 40 bucks just so that we can both have original signatures on it. NOW FOR THE QUESTION.

Ideally I would like to have my father fill out the I-864a, sign it, attach any necessary documents and then send it to me via e-mail in a pdf format so I can print it out and put MY signature on it.

Will that fly with NVC??

No - that won't fly.

The signature will be a copy - not the original.

Is your Father living with you, in the same household?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You need to have the forms with the original signature. They aren't allowed to be scanned/copied.

Ok -

Well - you may have to fork over some bucks for the form shipment.

The only time you can copy the 864(a) is if your bringing multiple people over on the same form. (example - child) - but for the "original" form, you will need original signatures.

That isn't correct for Mexico :bonk:

If you are doing electronic processing at the NVC then it will be sent in a scanned format and this is the correct way to do it. Only when you go to the interview at the consulate will you need the original with the original signatures. Given your situation, it sounds like this would be the easiest and most efficient as everything is done via email rather than snail mail. Check out the electronic processing wiki for the steps you need to go through for this.

You are in a little bit of a pickle here. This is what 8 CFR 103.2(b)-USCIS states:

"(4) Submitting copies of documents . Application and petition forms, and documents issued to support an application or petition (such as labor certifications, Form DS 2019, medical examinations, affidavits, formal consultations, letters of current employment and other statements) must be submitted in the original unless previously filed with USCIS. Official documents issued by the Department or by the former Immigration and Naturalization Service need not be submitted in the original unless required by USCIS. Unless otherwise required by the applicable regulation or form's instructions, a legible photocopy of any other supporting document may be submitted. Applicants and petitioners need only submit those original documents necessary to support the benefit sought. However, original documents submitted when not required will remain a part of the record. (Revised effective 6/18/07; 72 FR 19100 )"

Sending i864 via email, singing and sending back via email and printing it out would definitely be a copy of the doc. Sorry!

I don't know though why this rule matters so much. In my eyes it is crazy. They do not like copies because of the higher chance of fraudulent change of the original and making a copy of it to mask the change but I don't see why anyone would want to do that to this doc.

Well - of course if your doing electroinic filing - and you follow the rules for it. (see link in my second post about signatures).

However, OP didn't say he was doing electronic filing, but hard copy, so the answer stands. :thumbs:

this is the link to the DOS site for Mexico. The steps should be pretty much the same for all of the electronic processing consulates. I think the Wiki was done before Mexico was part of the program. :P
