Good Day everyone

... thanks for helping me out on my last 2 NVC questions ....

The NVC is moving pretty fast and I am sending in my I-864 packet today yet I've already recieved th IV bill, just yesterday !!! Praise God !!! but I do have a question and would like a little feed back if you all would be so kind:

I was wondering if anyone has had success in sending only the one most recent tax return. Afterall, the NVC is only requiring one for purposes of moving things along quicker ......... in my case, I do have other financial evidence such as a letter of employment for the past 9 years and recent paystubs and I also have my taxes for the past 3 years (my personal copy for 2010 and transcripts for 2009 and 2008)... they are all in my I-864 packet ready to send.

For 2010 I filed jointly with my husband whom I am filing the visa application for ....... however, those for 2009 and 2008 were filed with my ex-husband whose business losses brought our adjusted gross income pretty low in 2009 (not to the poverty level though)

I had been seperated for 5 years before my divorce was final, but filed jointly with my ex. I lived on my own income independently during those years, which by far was plenty. I have written a letter as well to explain this whole thing, but I'm not sure if the less said the better. I tried to put my self in the position of the NVC and thought an explanation might help to decypher my tax transcripts.... somewhere down the line my paperwork will end up in the American Embassy in Dakar, Senegal and I hear they like as much financial documentation as possible.

So what do you guys think ?.......

....... How many years of taxes should I send?

....... And if I do send the 3 years, is the explanation letter a good idea?

Sending the 3 years of tax returns/transcripts shows that you complied with the requirement to have filed.

They income evaluated will be your current and ongoing if you are a wage/salary earner. If you are self employed then the income used is line 22 of your 2010 tax return.

No need to send any sort of explanation. This is a fairly straight forward situation: the income is above or below the requirement.

They really need to change that form. They say that the 2 previous years are optional but many who only send last years return get an RFE so it is better to send three years. Last year is all that matters for the income requirements (actually current pay stubs and employment letter will show the current income better). Save yourself some heartache and just send all three years. You are right, most consulates seem to want three years of actual tax returns. We have been told that we also need to bring our 2010 taxes even though we started at NVC long before we filed these.

thank you Casprd and Anh ........ I think you're both right ....... I really appreciate the feedback ..... I still have a few hours before I go to the post office ... so I am going to think through the letter of explanation .... I just keep imagining the NVC reading these transcripts with another man's name next to mine and thought they might need more info up front ..... not sure yet what to do about the letter of explanation

I only sent this year 2010 tax return with 6 months pay stub and employment letter. I filled I-864ez. My AOS got approved. On line 19, you have to click on :

[] I have filed a Federal tax return for each of the three most recent tax years. I have attached the

required photocopy or transcript of my Federal tax return for only the most recent tax year.

I did not have good income in 2008 and 2009. It is upto you.

Ya, 30k will be good enough. you can check 1-864p for poverty guidelines for the income needed. Do not forget to include 6 months of paystub and employment letter stating how much you earn yearly and when you started working.

we sent in one year only as well and had no problem, but we also sent in pay stubs, and employment verification.
