Hello VJ Community!

I was wondering if my mom could write a third party affidavit for my I-30 application. I looked at the example form, and it said the person should have witnessed "first hand" evidence of a relationship. My mother has not met my fiancee in person yet. They have spoken on the phone a few times. HOwever my mother/family is very aware of our relationship that has been going on for 3 years. I am getting married in August, but will not be doing a wedding, so my mother will not be there for that either, therefore she will not be able to write that she was a witness for the marriage (like I saw on the example). Since they never met in person, does this mean she cannot write it? She won't be personally meeting him, till AFTER I file the I-30.

I want her to write it because she speaks and writes English well and would be able to write the affidavit, which is not the case for all the people in Dominican Republic, whom have actually witnessed our relationship in person.

If she cannot write it, Can I? I saw an example of a spousal affidavit too? Is this type of evidence okay?

04/11/2012 - Informed of interview via phone by DOS/ Got P4 email from NVC a few hours later that same day (May 4th)

05/04/2012 - Interview (APPROVED)
05/10/2012 - Visa ready and picked up at domex
05/15/2012 - POE in Boston (together)

06/05/2012 - Green card arrived
06/15/2012- Back to SS office with green card to reapply and inquire about delay
06/18/2012 - Picked up SSN at SSA office
06/22/2012 - SS card arrived by mail

04/24/14 - Sent I-751 to remove conditions

06/09/14 - Biometrics

11/2014 - RFE from USCIS requesting more evidence before approval

Late Jan - Sent further evidence of marriage

03/05/2015 - Got letter of approval for removal of conditions

03/15/2015 - Permanent 10 yr green card received via mail

In my case, we did a courtship affidavit in which 3 people that know of my relationship to my fiance and know us both went to a notary in DR. They each took their cedulas with them and were sworn under oath. In the affidavit it stated that they knew of our relationship from the beginning and that both my fiance and I know each other and that we are to get married within 90 days of his arrival to the USA. All their signatures are included as well as copies of their cedulas. Since it was written in spanish I got it translated and sent it in with my initial I-129F petition.

The form is an I-130 (not and I-30). Also, just to be clear, did you mean to ask if your mother could be a co-sponsor because you do not fulfill the minimum poverty guidelines to be your husband's sponsor? Or did you mean to ask if your mother could write an affidavit as to the bona fide nature of your relationship?

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

The form is an I-130 (not and I-30). Also, just to be clear, did you mean to ask if your mother could be a co-sponsor because you do not fulfill the minimum poverty guidelines to be your husband's sponsor? Or did you mean to ask if your mother could write an affidavit as to the bona fide nature of your relationship?

I had a friend of mine write an affidavit for my I-130. At the time she had not met my husband but knew the relationship was real based on converstaions I had with him in her presenese and her helping me shoping for wedding gown, and taking me to the airport to visit him. I also had letters from people who knew us both in Peru. I didn't have any problems with the letter from my friend. To the interview I took letters from every member of my family explaining why they could not be at my wedding. Although I was asked why they were not there they did not want to see my letters from my family.

I included affidavits from my sister and my best friend who came to our wedding. Also another couple friends who never met my husband but know me very well and knew all about our relationship from my joy and happiness! My hubby had his step mom and two friends who attended our wedding write letters. We had those translated into English and sent with our petition. I know they aren't requires but i wanted to include them AND it is a really beautiful thing to have forever (I included all of them in our wedding scrapbook). Good luck :)

My mom wrote one for my file. Just like you, my mom has not yet met my wife, but they have talked as well as exchanged gifts/cards etc. Also, my mom was well aware of our relationship from day 1.
