Thats what I thought. Whew....lol.

I'm going to just order mine and both parent's tax account return transcripts (line by line breakdown like 1040) from the IRS today.

I'll just attach the specific W-2's according to tax year with those corresponding transcripts.

1099's are used for interest income and other forms of non-employee income, not just the self employed or contractors.

So over the weekend I was looking for the 1099 form for my Mom's unemployment and it was not in the tax return. What I mean, is that the UC was filed, but, on the 1040 specifically it states "Unemployment Compensation" on the Joint Return. No other documentation is given to state theUC.

So I believe just sending the 1040's for my parents Joint Return with W2's suffice to break the individual incomes apart, since my father is the only joint sponsor.

In general there is no requirement to file the actual 1099's with the return with the exception of 1099-R, and only if there was income tax withheld on the 1099-R, so that is probably why the 1099-G was not part of your mother's return.

Also, as I was casually reading the forums, I saw a case where someone had the same kind of situation, being a student, staying with parents and not having enough income to be the sole sponsor for the beneficiary. Their parents were going to be the joint sponsor and made enough to clear the poverty line.

Well they got an RFE to show assets in the bank. Do I need to submit these items as I have been unemployed since 12-20-10? My current annual income is 0 (since I am still out of work) and that is what I have entered on the AOS form.

I do not see this as necessary as my joint sponsor makes more than enough to clear the poverty line for the household.

I want to keep my application short, sweet and to the point.

What do you think?

In general there is no requirement to file the actual 1099's with the return with the exception of 1099-R, and only if there was income tax withheld on the 1099-R, so that is probably why the 1099-G was not part of your mother's return.

The RFE's you've seen are probably based on different circumstances. When the joint sponsor qualifies on their own, it is best to provide an I-864 from them, no matter whether the petitioner and joint sponsor live in the same house. The reason is that only the I-864 fully and accurately reflect the joint sponsor's household size.

Ok. That makes sense now.

I also had a question for my portion (Petitioner) of the actual I-864. Since I am doing it a different way here.

Let me pull it up in just a minute here and formulate my question.

Ok..on the actual I-864 form now:

23. My current individual annual income is: I am unemplyoyed so I have put $ 0.00

Now number 24. is where I am getting confused, moreso due to all the blank entries I have.

A. List your income from line 23. Again: 0.00

Now, it states income you are using from any other persons in the household: My household is 2. Principal Immigrants and myself. I put nothing, since I am not using any of our income.

Now this is confusing.

D. This is where is says above person(s) in part B have completed i-864a (left unchecked)

E. The person listed above does not have to complete i-864a due to the intending immigrant has no accompanying Dependants. Again...left this unchecked.

I am not including any of my assets in this AOS. Just relying on my fathers income as Joint Sponsor.

I am pretty sure I have done this part correctly. But, I still want to know if this is the correct way it should done when filing two i-864s in this particular case.
