I'm not trying to give advice against VJ's policy but If he entered under the radar, he may leave under the radar because no one knows of his presence in the US except for his relatives. How DHS will find out he had an illegal entry into the US without him disclosing it. :hehe:

Because you don't know all the circumstances and in 4 years he might have applied for a drivers license in a state that allows this, or signed an I9 or have a bank account ...and on and on.

FYI to the OP... might want to file I130 now with him in the states, there is some discussion of DHS changing the filing location for I601 to the US. Not sure when and if this will happen, but its been discussed very recently by USCIS.

Regardless of being able to file a 601 waiver in the US the beneficiary will still have to leave the US for consulate processing as he wasn't properly inspected/paroled/admitted therefore he can't adjust outside of the circumstances Jim listed.

I do agree with filing the paperwork ASAP though.

A better shot at being banned from the US for life for material misrepresentation? He will have to mention his illegal entry.

He can file for the spousal visa and then he will have to leave to Mexico and file the I-601 waiver from there.

Hold your horses! Unless I missed it, the OP NEVER said where the illegal person came from originally! Again, assumptions and stereotypes point to Mexicans... Come on! Not all undocumented persons are Mexicans and not all Mexicans in the US are undocumented (a.k.a. illegal).

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

I guess the assumption I jumped to was thinking he was mexican. He could be canadian.

Actually that would be another assumption. He could be from Honduras,Ecuador or any of the other central/south american countries that would be able to fence jump.

10/13/2011 (Day ***) Received RFE-- Requesting that I provide documentation to prove I was never married in Uk or Illin
02/11/2012 (Day ***) Service request..Told its being reviewed by supervisor

24th March 2012!!!!!!!!!!! Email notifiying me of CARD IN PRODUCTION
03/26/2012 (Day 376) Emails confirming that my I-130 and I-485 have been approved.

4/2/2012 Green Card In Hand!

Unbelievable that my journey took this long but Im thankful

Next Stop Premed...Yup!

3/24/2014 Application for conditions to be removed

9/22/2014 APPROVED without interview.

When you say "came here illegally" what exactly do you mean? There is a big difference between coming illegally, or "hopping the fence", so to speak - and coming here with a valid visa and then overstaying.

Illegal is Illegal!! Hopping a fence is the same as driving a car and crashing through the border fence!! What dictionary do you use to find the meaning of illegal!!!!!!!!!:bonk:

I don't think it matters where this person is from. No need to argue. I got what I needed, and there's nothing more I can do to help, gave them their options now it's in their court, not sure which way they will go, but most likely which ever way they do, it will involve an attorney since I'm not much help.

April 14th, 2012 -- N-400 Sent to Dallas Lockbox

November 26th, 2012 – Damian Became a US Citizen!!!
