Hi, a friend of mine will like to know what are the chances he has to get a visitor visa. He's been in USA twice under J1 visa, but he got denied the visitor one last year. Now, his best friend has cancer and he would like to visit him. He is going to Europe next fall due he got a full scholarship to do a master program. Do you think this scholarship is a strong tie as proof he is going just as a tourist??? Thanks in advance for your replies.

Why was he denied the tourist visa the first time?

He told me the consul didnt review any of his documents, that she said he was too young and without family (he is single, 25 years old)and that's it. He also said that he suspect he would get denied because the first thing the consul ask was if he was going to renew the J1 visa, and by that time the consulate denied all J1 visa to returning students that didnt have visitor visa. The consul also asked the purpose of the trip and nothing else.

Jan 15, 2011: Touched

Jan 18, 2011: Received Biometric Appointment letter in mail

Jan 21, 2011: Biometric Appointment (Walk-in Successful)

Feb 10, 2011: Biometric Appointment (Originally Scheduled)

Feb 12, 2011: Received 1st text/email for EAD card in production and AP was APPROVED

Feb 17, 2011: Received 2nd text/email for EAD card in production

Feb 18, 2011: Received 3rd text/email for EAD card has been mailed out

Feb 18, 2011: Received AP!!!! YAY!!!!

Feb 22, 2011: Received EAD!!!!

Feb 22, 2011: Received letter for 2nd fingerprints :(

Mar 17, 2011: 2nd fingerprints

May 02, 2011: AOS Interview Approved!!!!!!

May 07, 2011: Received "Welcome to America" letter

May 09, 2011: Received Green Card. Yay!!!!!

Your friend could try, but Santo Domingo is almost legendary for denying any further visas after J1 or visitor visas applications and issuances...

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Does that mean my K1 will get denied because I got a J1 last year? :blink: I dont think it works like that. I think if the applicant has enough ties in the DR another non immigrant visa will be issued.

His B1 is not denied cos he has J1, his B1 was denied coz he does not have enough ties to his home country. Your thinking if he has enough ties to his home country are not good enough for CO..... sorry.

Just having an admission in college is never a good tie, you can give up admission anytime wht would it stop anyone from staying illegally in US and give up their admission in home country.

I dont think any sane person would rather stay illegally in the US instead of going to Europe to get a better education than they would ever get in the US :bonk:

You might think the other way, but this happens all the time, ppl enter and stay illegally.

People even enter US with student visa for US and they never show up at school......:)

There was that scam Uni in CA that was closed down earlier this year.

A question, why does it matter what we think the odds are?

Boiler you might want to double check on that, the Univ closed in CA was first of its kind - similar schools are available all over UK in abundance.

Hundreds of student from Asia get into such schools in UK and never ever show up for school, school puts in proxy attendence etc.

They have found schools operating with no classroom just an office in UK, 5 storey building will have 5 different school on each floor, all they have is office space.... ;)

So saying europe has better education......hmmmm I have lived there and experienced it first hand.

I've been to university in both the US and the UK and from my experience, the US system is better....
