Hi All,

I just got married to my new wife in China on the 22nd, I met her online last year in December on a match site, and we chatted since then, and met in Shanghai for a week in January and our feelings didn’t change since we already loved talking to each other online, we decided to get married, and I got her diamond ring and our matching bands, so I went back to her hometown in Shenyang to be with her family in March to marry and also go to our Wedding Studio appointment, we originally have the Wedding Party with Family set for October, but that might have to be pushed cause I was sort of using my second job as the income source to supply for the wedding, but have to be let go, since they gave me no choice but to change my part-time to full-time work, and I cannot handle 2 full-time jobs, so I will retain my main management job. But I am sure I can pass with our wedding studio photos, and normal photos together plus some with family. And she has my chat logs, and emails, and I will have to print out my text logs, web cam screen shots(why no voice logs? Because I am deaf (I have cochlear implant), but I can read lips and can speak English, I am sure I will have to make a statement on top of the logs explaining the absence of voice calls) I am able to understand her voice a bit without lips, but need to be with her longer to get used to it if I am to try talking on a phone, but at the moment that’s only limited to my Mother.

I plan to go back for a 3rd time in July.

I have some familiarity with immigration in the past. I was once married to a Thai lady when I was younger in 2002, and we did the K3, and that took only 4 months to the interview and visa approval in Bangkok. Yeah that was years ago, when the K3 was new. Unfortunately she became mentally unstable and also cheated on me, and we did both agree to a divorce and filed it without a lawyer and smoothly got it completed in 2003. I never filed the adjustment of status since she was still under the 1st year of her K3, and already had a temp work permit while waiting for the permanent EAD card; I was waiting till closer to the end of the 2 years before filing anything else because I wanted to make sure she was stable. Well luckily I found out before I filed anything and we got a divorce and she left me and moved to the other guys place. My ties with her were cut off for good, never to see her again, but word is out she now is a legal US citizen and making more money than me now and has a nice house and lives alone with 2 cats! LOL I have no clue or idea how she was able to remain on the K3 and continue the process, I did get a notice from immigration a while back for some request for info, I simply mailed back a statement and copy of our certified divorce and said that we divorced and this did not apply to me anymore, and I got a response saying she already adjusted…. Hmmm she got some good lawyer or forged something?

But anyway, I have some confusion about filing my I-130.

1. I will front-load it with lots of evidence, but regarding my certified divorce decree, do I need to talk all about my ex wife in a separate statement? Or can I just submit the divorce decree and not give out unnecessary info or data on my old K3 in 2002? I did put in the I-130 that yes I did file for my ex-wife in 2002, but also stated I divorced in 2003 and “never completed immigrant status”

2. I know this is an early question, but I am confused about all the users at Guangzhou where the spouse should be present at the interview (yes I will go out to be with her) but you’re not allowed in the embassy or the interview, so what is the bonus you get if waiting outside the consulate? Many say people make mistakes for not being present at the spouse interview? But how can they tell if you are not allowed inside? Is there some specific thing I must do for myself while I am in Guangzhou for the interview down the road? I sure can give her my passport and she carry it on top of her folders in display of the VO, My wife joked already that after I asked sample question, Where is your husband? She said “outside”

Hi I would get all the chat logs, phone logs, emails, plane ticket boarding passes, hotel receipts, wedding photos together in a note book about an inch thick. Put tabs on the pages so it's easy to flip through. She can hand that to them at the interview. If you can show some financial ties that will help too. ALSO I went to the consulate in Guangzhou and paid $50.00 to have my signature notarized. I did that for the EOR or Evolution of relationship letter. You can do that it's almost a requirement. You say you got married already in order for that you had to have done the Affidavit of Single status in which you showed them your divorce decree. I can't remember if that's needed or not. I will not be attending her interview I was just there in December and 3 trips total. I am hoping her interview will be in the next few months. We are almost done at the NVC. I think a few more weeks we should be done. If you can afford to be there for her interview then why not. I heard it takes about 2 weeks to get the visa after the interview. I can't wait it's been a long time for us.

You don’t have to include separate statement about your previous marriage. It is already long time ago. But you need to let your girl know all of this in case she is asked at interview. For Guangzhou, their concern might be that you used K-3 before (whatever you did AOS for your ex-wife) and you guys divorced just one year after your ex-wife entered USA. It could be regarded as a visa fraud, which might hurt your current petition and visa application. So you need truly to let Guangzhou aware that you was cheated and knew nothing about your ex-wife real intention when you were young at that time. A statement about it would help, from my view.

As for presenting yourself in Guangzhou, it is not a big issue. At interview, I saw only two USC were there with their girls (many ladies were there by themselves, like me). They are not allowed go inside and just wait outside. If you want to come, then why not? But it is not a must-be. The important is your guys’ true relationship.

If I were you I would front load all that you can, even include an EOR letter with information about your divorce if you haven't already sent it in. When you receive your NOA2 and your file is sent to NVC it will not seem as if you are trying to hide this information. Guangzhou is very tough on giving out pink slips for approval. I did not attend my wife's interview but I think we were lucky with a quick process.

2. absolutely not allowed inside, but the psychological value of yer lass showing the VO yer passport on interview day is worth something, I think (and others think also)

You really don't have to have tons of information about your ex's because they are looking at you relationship with your wife now. You had to submit the single status already in order o ge married and that is not required during the interview. Yes Darnell is correct I think they have made decisions even before the interview. I went with my wife and gave her my passport to take with her to show that I was downstairs in the coffe shop waiting. I have been to China 5 times. I also wrote a letter to the VO for my wife to give that gave a breif summary of my trips to China and that they please let us start sharing the rest of our lives together. We currently are going through our I 751 which is the removal of conditions on her and my son's green cards. You will want to keep everything along with once you get her visa all the information on credit cards, home and car loans along with bank account information, health, wills ect. So when the time comes to remove conditions you will have all the information. Keeps copies of everything you send them.

The financial ties will be sort of hard to present, I live in the US and she lives in China and I do not send any money to her at all, she wants me to just save my money and focus it on wedding party later and my new car, I will hand down my current car to her (She has a drivers license and drives her fathers car). I did buy her diamond ring, so that was on my tab, she paid for the wedding photo studio (2600 RMB) and yes I wanted to cover it, but she said it was my birthday gift and got a lot out of that with 12 hours and many make up sessions and scenes.

And when I was staying at her home, her Mom refused for me to pay at meals and her Mother would pick up the tab always, cause I was the "guest" I did however cover meals with her when we were both alone but she took care of the taxi fares.

I really enjoy her independence and she is just a sales promoter for make-up products, she studied in London for 5 years, so she does have a slight british accent.

I guess I have to get back to front-loading and the EOR is a new thing to me, so I will create one and add it, I can get it notarized here locally, then later at interview time, get it notarized at citizen services prior to interview?

about the affidavit of single, I never went to the US consulate in Shenyang, cause the appointment was to close to my departure and Id be unable to get married.

So I went to the Chinese consulate in San Francisco ahead of time with my divorce decree and affidavit and got it certified, but

it was a trip to mail them off after being notarized to the Secretary of each state of my residence and divorce state.

then at the marriage office in Shenyang, they didnt bother with my divorce decree, they just accepted my affidavit of singleness that was certified by the Chinese consulate in SF. I could have saved myself 100 dollars for rushing that decree to be notarized

by secretary of state and the consulate. Well at least I still have that copy (with local and secretary of state notarization) , I can save it for the interview if needed, and I will just send out my other local certified copy of the divorce decree with the I-130?

I have a scan of her passport page, but do I need to really have her birth certificate front loaded? it may take time for her to get it together and scan it, she has a all-in-one printer, but it needs to be translated as well.

Her birth certificate is not needed until the case reaches the NVC.
