She can apply for a tourist visa but very low chance of approval.

No lawyer nor congressman can speed up the process.

If I understand the five months correctly he should be close to the NOA-2. After that things will start to come together pretty fast.

They should focus on having everything ready to send to the embassy and just try to hang in there a little longer. This is a long, slow process and everyone has to wait their turn in line.

You are correct. Any filipinos applying for tourist visas must show GOOD reasons why the HAVE to return to PI and not go TNT {go illegal in the US.]

Thanks for confirming. I didn't want to speak out of turn but did think they were hard to get.

This is Staley; I'm using my friend's account.

Until we are together, can I bring her to the United States on a tourist visa, or will that mess things up with our K1 process?

Every country is different, but I think the overall message for getting a tourist visa while a pending application is that it will be denied unless you can overwhelmingly prove that they will return back. Which, in itself, is difficult because the application already implies an "intent to immigrate". I know in Brazil that there are others who tried and were denied. We looked into it and just decided that we would be denied also, so we did not waste our money.

Yep, the wait sucks really bad. We got our NOA2 after 6 months and now waiting for the next process through NVC then interview date.

The official word from USCIS is that 5 months is an approximate time and that you have to be 30 days past that to be officially considered outside of normal processing times. (ONPT) Congressman and Senators really can't do anything until that point. Lawyers can do nothing except take your money. However, my opinion is that your best bet is to contact your Senator or Congressman and get their constitutive advocate involved in the process. They seem to be able to get the ball rolling when everything else fails.

However, I haven't said anything that others have not already said. Guess I am just backing up some already great advice.

My friend is looking for an attorney to expedite the K1 process. The one he hired hasn't done much other than fill out the forms. They started the process October 28th. He and Beng are miserable; he wants to go to the Philippines to be with her, but cannot stay more than three months. He is at the internal review stage of the process. Can attorney speed things up? Anybody know a good one?

No. An attorney cannot speed things up. Many will be glad to tell you they can and take a lot of money though.

Although I am not a K1 filer, a Lawyer won't speed things up, nothing will, congressman calls, service request, all this stuff is useless it seems.
