Hello VJ,

I am quite confused about my 10year green card application next year. Would it be possible to apply 10year green card myself, w/o husband? My issues with him for me will surely boils down to end our marriage. Just so you have a little bit of our issues. He and I are arguing and fighting often times because of his illegal stuff. I don't want to elaborate things coz I still want it to be private. The whole thing is I did not know what he was doing, not until I came in the US and get married. It was late for me to know what he does. I am sick and tired of promises that things will change, however nothing has been changed since we got married. We have no house our own, he has no job, and no insurance. What do I do? Can I still get a 10year green card? or they will send me home instead.

Please give me infos about this matter. Mostly, to all members who has the same issues, but handled.

you can still remove your conditions without him, but you need to show you entered the marriage in good faith. Also, you will need to be divorced or almost done with the divorce when you apply. they will want to see the divorce decree. You will also have to come clean with your private information and husband's illegal activities with the USCIS. It can be done though.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Why don't you go home. Philippines has great weather 24/7/365. Very little stress over there, time is not importantant in PI. People are very friendly, Food is excellent and cheap. It's a much better place to live than the USA.

Yes, you can divorce and still stay in USA. After 3 years, depending on what Visa you arrived in USA you can apply for Citizenship.

Nope, you are wrong on that... If the marriage terminates before 3 years then she'll have to wait 5 years from the date of her first Greencard issuance to apply for citizenship.

Yes, you will have to be honest throughout the rest of your process. As great as the U.S. is, if you no longer are married, will you have any family here? Think about your future and if staying will make you happy before you go through the entire process. Also if you're trying to remove conditions to receive your 10 year green card, you need evidence that your relationship is established and you guys plan on being married. As in, house documents, joint tax returns, pictures of you guys together, join bank accounts, etc. If your can't provide any evidence, USCIS may not approve the application.
