Hi there,

My husband has his immigration interview this Friday and I am preparing to fill out the I-864 form. I have a couple of specific questions that i'm hoping people can answer before I complete the form.

1) Part 2, Question 4 (Country of Citizenship): If I am both a Canadian citizen and an American citizen, do I put that I am a dual citizen, American citizen or Canadian citizen?

2) Part 5, Question 21 (Household Size): Do I count my spouse twice? I know it says not to count anyone twice, but the instructions seem just a tiny bit vague. I'm assuming if I count my husband as the intending immigration, I don't put one down for my spouse in part 21c even though I am in fact married.

3) Part 5, Question 23 (Current Annual Income): I still have a job here in Canada, but it will not likely be continuing in the States. Do I still put my income here in Canada or do I put 0?

4) Part 5, Question 25 (Federal Income Tax Returns): Similar question to part 3, if I wasn't earning any income in the States, but was earning income here in Canada, do I put 0 or whatever I earned in Canada?

1) US Citizen. You are not a US Green-card holder, Note in some cases an I-864 may be filed by an LPR (Green-card holder) for example if my wife a citizen from China were to sponsor someone, she would state Chinese Citizen.

2) Do not count the intending immigrant as a spouse when spouse is the intending immigrant being sponsored. So No do not count as a spouse...

3) Yes current Canadian income.

4) Even when living outside the USA you still need to file US returns, even when exempt from paying tax ob foreign income. Yes What your foreign income is.

Note I-864 also requires evidence of a US Domicile.

Unless this is one of the differences when applying from Canada (there are some unique differences for Canadian immigrants) a US based income or a job offer will be needed. If your income will not continue in the US then a joint sponsor (US based with US income) ought to be secured.

Part 2, Q4 is about the immigrant, not the sponsor. Enter spouse's citizenship here.

Part 5, Q21c is asking about persons NOT sponsored. Husband is being sponsored so he would not be entered here.

Part 5, Q23 - Enter your current annual income (in USD).

Part 5, Q25 - Enter the income amounts from your US tax returns for the 3 most recent tax years. If you didn't file, then you may have a problem. Even when working outside the US you need to file. No tax may be owed, but the returns need to be filed.

Hi again,

One more question regarding my current income. If I do put my current Canadian income (which won't continue in the United States), won't that automatically be counted towards the income requirements? I thought that unless you're income is going to continue in the States, you can't actually count it. So I guess my exact questions are:

1) If I put my current Canadian income in Part 6, question 23, do I copy it over for Part 6, question 24a?

2) And if I copy it over for Part 6, question 24a, do I then include it in the total household income for Part 6 question 24 c?

If your income won't continue I assume that this will come up at the interview. At that point you would be working with a zero income amount (for immigration purposes) and would either need to supply documentation of sufficient assets or a joint sponsor.

Hi there,

That's true. Actually my husband (the intending immigrant) will be supplying the income since his will continue into the States. But i'm still confused. Can someone take me step by step what I should put if I do earn income now but it won't continue?

One other thing, do I need to state the currency conversion I used somewhere on the form? (i'm using the currency conversion for today).

Hi there,

Sorry to bump my own thread. The main reason i'm confused is that if I do put down my current income which will not continue in the States, according to the little blurb on page 4 question 24 c, it will count against the poverty guideline , which it shouldn't since it will not continue. Therefore, it sounds like i'd be filling out the form wrong.

So can someone just clear this up. Knowing my situation, what specifically do I put for:

1) Part 4 Question 23

2) Part 4 Question 24

3) Part 4 Question 25c

It looks like my topic has fallen off the radar again. Can someone please help me out with my questions in the above two posts? My husband's interview is on Friday and he leaves tomorrow which means I only have today to complete the I-864 form.
