Tourist overstayed using International Drivers License while petition of spouse is on process.

Timeline

This is what i have: international drivers license, goverment issued foreign drivers license and foreign passport. All valid.. By the way im residing in california.

SEP 07 2007 - Entered US w/ B2 Visa

NOV 29 2009 - Met my USC wife

OCT 14 2010 - Got married in San Diego

MAR 03 2011 - AOS package sent to USCIS

MAR 07 2011 - AOS package received by USCIS

MAR 29 2011 - Notice date for all forms

APR 01 2011 - NOA1 receipts arrived

APR 04 2011 - Biometrics appt letter arrived

APR 06 2011 - Biometrics walk-in successful

APR 29 2011 - Notice date for I-485 Initial Interview

MAY 04 2011 - Received Initial INTERVIEW LETTER!

MAY 13 2011 - Received EAD/AP card. Applied for SSN

MAY 19 2011 - Social Security card arrived

JUN 07 2011 - AOS INTERVIEW - Approved!!!!

JUN 10 2011 - Card production ordered!!

JUN 15 2011 - GREEN CARD Arrived!! :)

I think CA only gives new residents 10 days to get a CA DL.

What document do you have that gives you the right to be in the US for the duration of your stay? A passport is not the answer, wither it's a CG, valid 194, or your NOA for AOD process.

Is NOA2 is the NOA for AOD process?

coreection AOD should have been AOS process, and yes the NOA2 is the document that gives you the right to be in the US for your duration of stay.

Police has no right to ask for a Green Card or a visa. None. Zero. Nada. Nilch.

Police has the right to ask for a valid ID, which is the passport. If they then look for a visa and there's none or it is expired, they will issue a citation. They will not call ICE. Period.

Sorry for a small moving out of the original topic, but I'm curious about this, outside the context of this thread (when one already has the card).

So, the green card says it should "be carried with at all times." Why exactly should one be carrying it, if the police can't ask for it?

And to the later point, mentioning to show a passport - as far as I see the point of green card is that it's a government issued ID. So when you have a green card, do you still carry also the passport all the time?

I don't see in the list of obligations for a LPR any mention of maintaining a valid passport - not that it's a good idea to let it expire but still. A potentially lost or stolen GC is expensive but easier to replace than a stolen passport.
