citizenship of my K2 son

I got my 10 yr GC last year of October, my son came here as a K2,his GC will expire this year on October, I was thinking I will file my Naturalization asap so I don't need to apply for his GC and he would be automatic to be naturalize, my question is:

1). I will be going for a vacation by June this year for a month in the Philippines, I am hoping it doesn't affect my application?

2). Is there any necessary papers to fill up for my son so he would be included in the application? or is there any process to be done after my naturalization so he can be automatic to be a citizen also?

Timeline

K-2 visa was expired the moment they enter the USA, the visa expiration has nothing to do with when to file to adjust status, remove conditions etc... It only has to do with when to enter the USA by.

If K-2 is under age 18 or so US Citizen step parent can adopt and get citizenship that way, however in either case the NON-Immigrant needs to first be an immigrant, as in (Green-Card Holder) if living here and does not have a green-card, cannot get automatic citizenship through a parent's citizenship.

K-2 needs to first adjust status and get a green-card before can become a citizen.

To answer questions:

1) No, a period less than 6 months out of USA will not effect citizenship process.

2) File an N-600 for (Green-card holding) child after naturalizing or being adopeted by US Citizen step parent, to get naturlization cert for child.

BIG difference between a visa and a green-card. Visa is a document pasted in a passport allowing entry to the USA, K-2 is a one time entry. Green-card allows residing in the USA.

You can apply for citizenship 90 days before the 3rd anniversary of your green card.

Naturalization:

11/22/2010 Sent N400. Day 01

11/30/2010 Check cashed. Day 08

12/02/2010 NOA. Day 10

12/10/2010 Biometrics. Day 18

02/17/2011 Interview. Day 85

02/17/2011 Oath Ceremony. Day 85

02/18/2011 Applied for U.S. Passport Book/Card. Day 86

02/23/2011 Passport application received. Day 91

03/10/2011 Passport book received. Day 106

03/11/2011 Certificate of Naturalization returned. Day 107

03/12/2011 Passport card received. Day 108

If your son is under the age then he can piggy back off your application..

Take a look at the N-400 timelines, that would give you a better idea of what is what i mean timeing wise.....if you time your application correct you should be fine.

Looking at it and if i wher you i would file about a month before you take off...get your fingerprints done just before you leave,then there is a delay from fingerprints to interveiw then last oath...all in all about 4/ 5 mths from start to finish...

when you get back home there should be a interveiw letter there waiting fingers crossed.....all about timeing tho..

Nope, just file an N-600 for child's certificate, or you can also apply for a US passport showing basis for citizenship, (Birth cert and your naturalization cert)

Nope, just file an N-600 for child's certificate, or you can also apply for a US passport showing basis for citizenship, (Birth cert and your naturalization cert)

Save your cash ....Just apply for your childs USC- PP when you apply for yours same time..no need to spend all that money if there is no need..US passport is all your son will ever need to prove he's a ucs :thumbs:

Nigel answered that.

Yes, can simply apply for passport as proof of citizenship. Son/Daughter can always file an N-600 for a cert if it is ever needed in the future.

You are correct that he will derive Citizenship through you. He will derive this citizenship only after you have obtained your citizenship through naturalization. Read the instructions for filing N-600 on the USCIS Website. You must file on the kids behalf separately.

I would say that u just have you GC last October if you obtain your GC by US citizen.. you should w8 3yrs prior to be eligible to apply for Naturalization. Speaking about your Child Status his GC will going to end Soon.If his/her under costudy on His lastname(2NDfather) which is your US citizen spouse

and the child were under 18 yrs of age Regardless of money matter I prefer apply a Passport Card for her/him but You must be A US citizen. what they need is Proof of Parent's Citizenship certificate and your child GC and Birth certificate But you still need to get a citizenship certificate for {Him/her} its very useful if he/she wants to work in the government just necessary.
