Do I need 2010 Tax Returns

Timeline

Hi,

My wife's interview is March 3rd. Do you think I need to file my 2010 taxes? I wanted to wait till she receives her SSN?

Do you think they'll ask for 2010 taxes at the interview?

The 2010 ones won't be required until 18 april & after. You already submitted the affidavit of support, so there is no reason 2 worry about this. You can send your wife your W-2s just in case they ask, but the affidavit of support was accepted w/ your 2009 tax return. Your wife just has to tell them that your return hasn't been filed yet.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

I am hoping that you are right!

My husband will face his interview on March 10th with my 2010 income being less than the required amount because I spent over half of the year in Trinidad. As you say, the I-864 Affidavit of Support was approved with my 2007, 2008, and 2009 tax transcripts, W2 forms, and Employer Compensation forms that have all been submitted. Thanks to everyone posting their experiences and suggestions, my husband will be going to the March interview with my 'lacking' 2010 W2 form, along with my current pay stubs, my 2011 Employer Compensation form, AND a W7 waiting to be completed for my 2010 taxes, which needs his updated passport/visa information. He is fully prepared to explain that in order for me to file MARRIED on my 2010 taxes, I need his updated passport/visa information, and once received, I will file for my 2010 taxes and have access to a tax transcript for their files.

This is the route we are taking as I am betting on your CURRENT income outweighs your previous year's income. I will post the interview information and let everyone know for sure.

Apologies if I state in a comment that my husband and I have been together for years & years. It's just that I can hardly remember a time when he and I were not together.

Ahhhhhhhhhh!!! We are currently in Administrative Processing with no time-lines to guide us!

My husband is looking at cars in Trinidad for me as his wish has come true! Me a Trini-Wife!

BUT

I will call DoS weekly to check the progress and I will not give up hope.

July of 2011 is the cut off date for us, when I will either start construction on a home here in the US or return to Trinidad to be with my husband.

As LOTO always said: Take at least 6 pay periods of pay stubs just in case they have any questions. It will show that the spouse is still working at a continued income that meets or exceeds the guidelines. It's more of an insurance than anything. But the other's are correct...2010 taxes are not required at this point. Good luck.

FWIW, when i did the AOS for my wife I sent transcripts an w-2s for 2006, 2007, 2008 and just my w-2 for 2009 and my last 6 months of pay stubs (i am military, so they issue the complete Leave and Earnings Statement once a month). My wife had her interview on 15 April 2010 and she was never asked anything about my 2009 tax return or my income....although I did e-mail all updated info for her to print out and take to the interview.

I know I read that once the AOS is signed it is good for one year. (cant find it right now)...but some consulates might want an updated AOS if it has been some time since it was signed. If you provide the previous years and you have increased income over the 3 years you should have no worries. It is a good idea to send any updated income evidence before the interview just in case they ask.
